On the example of important cases of music piracy it will be shown how courts struggled with that topic. As this essay is mainly focused on the UK, the cases of Newzbin and Newzbin2 will be examined in detail, as those show important developments in both subsuming online piracy and enforcement. The legislative perspective will be examined on the example of three strike laws, which provide the so-called graduate response- an alternative way to litigation. It will be demonstrated on the examples of the UK’s Digital Economy Act and the French HADOPI law what new measures are provided and how they are operated. This will be followed by a conclusion containing the personal opinion of the author.

To do so, it first introduces the concept of Web 2.0 and discusses its relevance to online copyright infringement in the music industry. In addition, current legislative framework both at the international and E.U. level is discussed in order to provide the reader with a picture of the current enforcement system. In a number of E.U. Member States as well as outside the E.U., there have been legislative efforts to control copyright infringement online. Graduated response is one of these systems which is adopted and being implemented by a few Member States. However, there have been strong reactions by user groups against this system in that the system threatens individuals' fundamental rights such as right to privacy, freedom of expression and freedom to access to information. In light of these reactions, this paper argues that the efforts of legislators to introduce stricter measures are futile and limit fundamental rights. This paper suggests that the legislator, instead, should introduce an exemption into the current legislation to protect Internet users who exchange media online for noncommercial purposes. The proposed system allows for a more fair balance between copyright owners' exclusive rights and the fundamental rights of individuals. On the one hand, it leads to a more liberal online environment where individuals freely and legally exchange copyrighted media; on the other hand it secures the right owners' economic rights and thus the incentive for creation is still effective.

In current debates over copyright law, the author, the user, and the pirate are almost always invoked. Some in the creative industries call for more legal protection for authors; activists and academics promote user rights and user-generated content; and online pirates openly challenge the strict enforcement of copyright law. In this book, James Meese offers a new way to think about these three central subjects of copyright law, proposing a relational framework that encompasses all three. Meese views authors, users, and pirates as interconnected subjects, analyzing them as a relational triad. He argues that addressing the relationships among the three subjects will shed light on how the key conceptual underpinnings of copyright law are justified in practice. Meese presents a series of historical and contemporary examples, from nineteenth-century cases of book abridgement to recent controversies over the reuse of Instagram photos. He not only considers the author, user, and pirate in terms of copyright law, but also explores the experiential element of subjectivity—how people understand and construct their own subjectivity in relation to these three subject positions. While the public and the media have been distracted by the story of Napster, warnings about the evils of "piracy," and lawsuits by the recording and film industries, the enforcement of copyright law in the digital world has quietly shifted from regulating copying to regulating the design of technology. Lawmakers and commercial interests are pursuing what might be called a technical fix: instead of specifying what can and cannot be done legally with a copyrighted work, this new approach calls for the strategic use of encryption technologies to build standards of copyright directly into digital devices so that some uses are possible and others rendered impossible. In Wired Shut, Tarleton Gillespie examines this shift to "technical copy protection" and its profound political, economic, and cultural implications. Gillespie reveals that the real story is not the technological controls themselves but the political, economic, and cultural arrangements being put in place to make them work. He shows that this approach to digital copyright depends on new kinds of alliances among content and technology industries, legislators, regulators, and the courts, and is changing the relationship between law and technology in the process. The film and music industries, he claims, are deploying copyright in order to funnel digital culture into increasingly commercial patterns that threaten to undermine the democratic potential of a network society. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume.
