Más allá de la importancia intrínseca que esta actividad presenta, el abastecimiento de agua revela un ámbito de análisis jurídico en el que se entrecruzan instituciones diferentes, regímenes diversos, planteamientos divergentes y un entramado normativo tan ingente que convierten este aprovechamiento hidráulico, sin temor a excedernos, en un punto de intersección básico dentro del Derecho administrativo. La vinculación entre dos instituciones jurídicas clásicas, el dominio público y el servicio público constituyen la base de la que arranca el estudio que aborda la autora, enmarcando el régimen jurídico del abastecimiento de agua. A partir de ahí el análisis se detiene en las diversas cuestiones jurídicas que suscita la prestación de este servicio público. Por una parte, la disponibilidad de los recursos hidráulicos destinados al suministro domiciliario en cantidad y calidad adecuada, los títulos de intervención sobre los mismos, las instancias administrativas competentes en cada caso y el régimen de explotación y gestión de las infraestructura hidráulicas imprescindibles para el aprovechamiento. De otro lado, se profundiza en la naturaleza de este servicio público local y en las posibilidades que para su gestión se abren no sólo a los Municipios, en los que reside la competencia primaria para el cumplimiento de la prestación, sino también a otros entes administrativos de mayor dimensión y capacidad. Por último, se presta especial atención al régimen jurídico aplicable a los usuarios del servicio y a su posición respecto a los gestores, públicos o privados, del mismo.

Large amounts of water have been used for agricultural purposes at very low prices for too long; there is an uncontrolled use of most aquifers in rural areas which result from ineffective control by the public administration; per capita consumption continues increasing as well as water used for industrial and energy generation, the construction and tourism sectors and for recreation activities. In fact, they have all exerted additional pressure on available water resources. In order to face the above challenges, water policy has made a gradual shift towards more rational and sustainable management of water resources. This has also been influenced by the European Water Framework Directive about which, as the book discusses, there are both myths and misunderstandings.
