Book excerpt: L'article 6§1 de la CEDH dispose que toute personne a droit à ce que sa cause soit entendue équitablement, publiquement et dans un délai raisonnable, par un tribunal indépendant et impartial, établi par la loi, qui décidera, soit des contestations sur ses droits et obligations de caractère civil, soit du bien-fondé de toute accusation en matière pénale dirigée contre elle. La notion d'équité revoie au principe d'égalité des armes, notion prétorienne issue de la jurisprudence de la Cour EDH. Suite à la réception du principe d'égalité des armes en droit français, les privilèges du Ministère Public et plus particulièrement du Procureur Général, ont été mise en lumière. En raison du net désavantage existant entre les prérogatives des parties au procès pénal, les prérogatives du Ministère Public ont été amoindries en matière d'appel. Néanmoins, ce principe n'a pas abouti à une égalité absolue, en raison notamment du statut du Parquet. Bien que nécessaire, l'évolution des prérogatives des parties suite à la consécration du principe d'égalité des armes, nécessite quelques ajustements. Une augmentation des prérogatives du mis en cause serait notamment souhaitable.
