This book was released on 2017-06-23 with total page 23 pages. Available in PDF, EPUB and Kindle. Book excerpt: Seminar paper from the year 2013 in the subject Law - Public Law / Constitutional Law / Basic Rights, grade: 80, University of South Africa, language: English, abstract: The principal objective of this paper is to critically analyse how the post-1994 South African government has reacted to civil disobedience, when it is the very tool that has played a large role in bringing them to power. The new rainbow nation has had unarmed confrontation with the State in areas of racial harmonisation, socio-economic issues and unreasonable governmental policies. While acknowledging that civil disobedience is at cross purpose with the law, the paper establishes that civil disobedience and the rule of law should be balanced in a healthy democracy. The citizenry should be made aware of its rights and obligations imposed by the constitution. On the other hand, the State’s response to civil disobedience should be one enveloped in legal authority. Thus civil disobedience in any democracy should not be met with a knee jerk reaction. The paper also scrutinizes the divergent views on law and morality. Divergent as they are, the common denominator is that no society can do without intoleration, indignation and disgust which in the end may lead to civil disobedience. This study will define the concept civil disobedience and rule of law. The link between civil disobedience and the rule of law shall be explained through theories of legal positivism and natural law in particular the Hart-Devlin debate and the Hart-Fuller debate.

Book Synopsis Civility and Disobedience by : Burton Zwiebach
Download or read book Civility and Disobedience written by Burton Zwiebach and published by Cambridge University Press. This book was released on 1975-06 with total page 254 pages. Available in PDF, EPUB and Kindle. Book excerpt: Originally published in 1975, this book seeks to examine the problem of political obligation: when are we obligated to obey the laws? It presents a critique of traditional justifications of obligation - especially of social contract theory - and attempts to develop a fresh theory of obligation as both justified and limited by the need to substitute the culture of civility for the violence and barbarism of pre-political society. Civility, it is argued, can be attained by the creation of a common political life, characterised by equality, liberty, participation, and accountability of public authority. Dr Zwiebach's argument on behalf of a broadened conception of civility and disobedience was a significant contribution to the important dialogue on political obligation, on a more civilised notion as 'common life', on 'right', 'politics', and on the strengths and weaknesses of the theory and practice of liberalism.

Available in PDF, EPUB and Kindle. Book excerpt: In this stimulating collection of studies, Dr. Arendt, from the standpoint of a political philosopher, views the crises of the 1960s and early '70s as challenges to the American form of government. The book begins with "Lying in Politics," a penetrating analysis of the Pentagon Papers that deals with the role of image-making and public relations in politics. "Civil Disobedience" examines the various opposition movements from the Freedom Riders to the war resisters and the segregationists. "Thoughts on Politics and Revolution," cast in the form of an interview, contains a commentary to the author's theses in "On Violence." Through the connected essays, Dr. Arendt examines, defines, and clarifies the concerns of the American citizen of the time.--From publisher description.
Book Synopsis Civil Disobedience by : Tony Milligan
Download or read book Civil Disobedience written by Tony Milligan and published by . This book was released on 2013 with total page 179 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Civil disobedience is a form of protest with a special standing with regards to the law that sets it apart from political violence. Such principled law-breaking has been witnessed in recent years over climate change, economic strife, and the treatment of animals. Civil disobedience is examined here in the context of contemporary political activism, in the light of classic accounts by Thoreau, Tolstoy, and Gandhi to call for a broader attitude towards what civil disobedience involves. The question of violence is discussed, arguing that civil disobedience need only be aspirationally non-violent and that although some protests do not clearly constitute law-breaking they may render people liable to arrest. For example, while there may not be violence against persons, there may be property damage, as seen in raids upon animal laboratories. Such forms of militancy raise ethical and legal questions. Arguing for a less restrictive theory of civil disobedience, the book will be a valuable resource for anyone studying social movements and issues of political philosophy, social justice, and global ethics."--Publisher's website.

Available in PDF, EPUB and Kindle. Book excerpt: Civil disobedience, the refusal to obey certain laws, is a method of protest famously articulated by philosopher and writer Henry David Thoreau in his 1849 essay “Civil Disobedience.” Thoreau believed that protest became a moral obligation when laws collided with conscience. Since then, civil disobedience has been employed as a form of rebellion around the world. But is there a place for civil disobedience in democratic societies? When is civil disobedience justifiable? Is violence ever called for? Furthermore, how effective is civil disobedience?
