Book excerpt: At the moment, no other European city attracts so much fascination as the city of Berlin. An unrivalled symbol of modern urban life, Berlin is a dynamic city whose inhabitants, in the course of the past two centuries, have lived through both the rapid growth and the violent destruction of the institutions of civil society, several times over. This volume situates itself within these developments by presenting, for the first time in English, a sample of the best, recently written essays on contemporary civil societies, their structural problems, and their uncertain future, written by scholars with a close, long-standing relationship with the city. They are pre-occupied with a broad sweep of substantive themes, but in each case they focus upon one or other of the key trends that are shaping actually existing civil societies.

Book excerpt: The contributions focus on succession and obligation law norms shaping the legal status of an heir and their comparison within Polish and German law systems. They analyse the impact of the instruments of contract law on the status of an heir. The adopted methodology combining the internal-national and external-comparative perspective allows the authors to present “similarities in dissimilarities” within institutions of the German and Polish succession law. The broad analyses of legal doctrine and jurisprudence can serve as a source of knowledge and points of reference for legal practitioners, courts and legislators.

Available in PDF, EPUB and Kindle. Book excerpt: Europe is stumbling from crisis to crisis. The financial and debt crises are endangering the European currency union; referenda in several EU countries show widespread Euroscepticism; the economy is only slowly regaining momentum; unemployment remains high in many Member States; and the refugee crisis has deepened political divisions. We need an answer to the question of how to rescue the Euro and keep Europe together. In this volume, renowned German researchers and leading practitioners provide pragmatic recommendations. Their plea for a democratically legitimized Euro Finance Minister, a new economic approach, a common Eurozone budget, and minimum social standards are the prerequisites for a fair, stable, and prosperous Europe.

Book Synopsis Dalhuisen on Transnational and Comparative Commercial, Financial and Trade Law Volume 4 by : Jan H Dalhuisen
Download or read book Dalhuisen on Transnational and Comparative Commercial, Financial and Trade Law Volume 4 written by Jan H Dalhuisen and published by Bloomsbury Publishing. This book was released on 2022-05-05 with total page 485 pages. Available in PDF, EPUB and Kindle. Book excerpt: “... a highly valuable contribution to the legal literature. It adopts a useful, modern approach to teaching the young generation of lawyers how to deal with the increasing internationalisation of law. It is also helpful to the practising lawyer and to legislators.” (Uniform Law Review/Revue de Droit Uniforme) Volume 4 of this new edition deals with movable and intangible property law. The book addresses the transformation of the models of movable property in commercial and financial transactions between professionals in the international flow of goods, services, money, information, and technology. In this transnational legal order, the emphasis in the new law merchant or modern lex mercatoria of movable property turns to risk management, asset liquidity, and transactional and payment finality. Particular attention is given to the notion of assets and asset classes, the inclusion of monetary claims, the transformation of assets in production and distribution chains, and the type of user, income and enjoyment rights that can be established in them, when they become proprietary, what that means, the role of party autonomy in the creation and operation of these rights, and how they are handled between professional participants and upon a sale to consumers. The volume compares common law and civil law concepts - the one being geared to improving value, the other to consumption; it then identifies their relevance especially in modern finance, and concludes by indicating future directions. The complete set in this magisterial work is made up of 6 volumes. Used independently, each volume allows the reader to delve into a particular topic. Alternatively, all volumes can be read together for a comprehensive overview of transnational comparative commercial, financial and trade law.
Book Synopsis Weaponizing EU State Aid Law to Impact the Future of EU Investment Policy in the Global Context by : Pamela Finckenberg-Broman
Download or read book Weaponizing EU State Aid Law to Impact the Future of EU Investment Policy in the Global Context written by Pamela Finckenberg-Broman and published by Springer Nature. This book was released on 2022-09-28 with total page 327 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides a comprehensive analysis of how EU state aid law is shaping the future of EU investment policy in a global context. It examines in detail how EU state aid policy and practice interact with the EU investment regime on the internal market and affect the external trade relations of the Member States and the EU alike. The debate this book engages in concerns competence, i.e., which body delineates the scope of state aid law and policy (now and in the future) when and where it intersects and collides with another distinct legal field: investment protection. Pursuing a doctrinal approach to the topic in the light of EU law and international law, the book analyses the interaction of the EU’s trade, state aid and investment policy. This is done by posing the following research question: How is EU state aid law shaping the future of EU investment policy in a global context? Further, the book puts forward three corresponding arguments. First, this influence can be seen in the EU’s incorporation of clauses promoting fair competition and state aid policy in international trade agreements. Second, EU state aid law and policy contributed to recent internal developments which led the Member States to terminate their bilateral agreements with each other (intra-EU BITs) by the end of 2019. Third, the EU has been working to replace the BITs between its Member States and third countries (extra-EU BITs) with its own trade agreements, which are aligned with EU legislation. This combined analysis of EU law and international law yields a number of interesting conclusions. The book addresses a highly topical and rapidly evolving area of EU law and international investment law. It is also the first book to provide a comprehensive approach to the interplay of state aid rules and EU investment policy internally and externally, i.e., within the EU and on a global scale. As such, it closes an important gap in the extant literature on international and EU law.
