Book excerpt: "James Coriden offers a vision of canon law in the Catholic Church - seeing it not as an instrument of control but as a guide and guarantee of freedom for believers. In the process he emphatically joins the ongoing debate about the role of church law, a debate that he believes "will have profound implications for the long term," possibly reshaping the law and indeed "the very face of the church." While his message is addressed primarily to professional canonists, it will resonate among all Catholics who care about the way their church functions." "The view of canon law that unfolds in these pages is that of a ministry that upholds the freedom of believers and the good order of the community. This is based on the assumption that "church" is first of all a local community rather than a global structure. The test of effective law depends upon its service to the lived experience of its members in their own cultural, economic and social situations." "The concluding section of this book sets forth "An Urgent Agenda for the Future of the Ministry," particularly in the way church law is revised and amended."--BOOK JACKET.Title Summary field provided by Blackwell North America, Inc. Reprinted 2004 by The Lawbook Exchange, Ltd. LCCN 2003052789. ISBN 1-58477-366-9. Cloth. $150. * The Library of Congress has one of the largest collections of published Canon Law materials in the world. This bibliography, which includes all items catalogued before 1980, is thus a powerful guide to a body of legal literature that dates back to the birth of printing. The first three sections cover early editions of the Code of Canon Law, the code's historical foundations and the decisions of the Roman Rota, or the Church's jurisprudence. The remaining sections correspond exactly to the divisions of the Code of Canon Law and cover such subjects as persons, things, procedural law and crimes and penalties. Comprehensive author and subject indexes are included as well.

Book excerpt: With the promulgation of the motu proprio Mitus iudex Dominus Jesus for the Latin Church and the motu proprio Mitis et misericors Jesus for the Eastern Catholic Churches, both dated August 15, 2015, Pope Francis addressed the calls during the Third Extraordinary General Assembly of the Synod of Bishops (October 5-19, 2014) for a simplified procedure for the declaration of the nullity of marriages. Pope Francis introduced a briefer process to be conducted by the diocesan bishop and he simplified the current ordinary nullity process. The new procedural norms went into effect on December 8, 2015. New legislation always challenges first and foremost the practitioner: how is the new legislation to be understood and applied? Immediately after the new law was made public, a number of articles on this new legislation were published in The Jurist. The School of Canon Law of The Catholic University of America organized a March 2016 Workshop on the very topic of this important procedural reform. These articles are now brought together in one volume to assist those who work with these norms in the various tribunals dealing with marriage cases. It is hoped that this volume will be of great service to all those who serve the people of God in the ministry of justice, and that these contributions will truly be a help in understanding and applying the new norms.

Available in PDF, EPUB and Kindle. Book excerpt: In the first study of its kind Mary McAleese subjects to comprehensive scrutiny the Roman Catholic Church’s 1983 Code of Canon law as it applies to children. The Catholic Church is the world’s largest non-governmental organisation involved in the provision of education and care services to children. It has over three hundred million child members world-wide the vast majority of whom became Church members when they were baptised as infants. Canon law sets out their rights and obligations as members. Children also have rights which are set out in the 1989 United Nations Convention on the Rights of the Child to which the Holy See is State Party. The impact of the Convention on Canon Law is examined in detail and the analysis charts a distinct and worrying sea-change in the attitude of the Holy See to its obligations under the Convention since the clerical sex abuse scandals became a subject of discussion at the Committee on the Rights of the Child, which monitors implementation of the Convention. Mary McAleese wins Europe’s richest theology prize for her study of canon law. The former President of Ireland Mary McAleese has won one of the Catholic world’s most prestigious prizes, the Alfons Auer Ethics Award, from Tübingen University in Germany for her doctoral thesis on Children’s Rights and Obligations in Canon Law.

Available in PDF, EPUB and Kindle. Book excerpt: Firmly rooted on Roman and canon law, Italian legal culture has had an impressive influence on the civil law tradition from the Middle Ages to present day, and it is rightly regarded as "the cradle of the European legal culture." Along with Justinian’s compilation, the US Constitution, and the French Civil Code, the Decretum of Master Gratian or the so-called Glossa ordinaria of Accursius are one of the few legal sources that have influenced the entire world for centuries. This volume explores a millennium-long story of law and religion in Italy through a series of twenty-six biographical chapters written by distinguished legal scholars and historians from Italy and around the world. The chapters range from the first Italian civilians and canonists, Irnerius and Gratian in the early twelfth century, to the leading architect of the Second Vatican Council, Pope Paul VI. Between these two bookends, this volume offers notable case studies of familiar civilians like Bartolo, Baldo, and Gentili and familiar canonists like Hostiensis, Panormitanus, and Gasparri but also a number of other jurists in the broadest sense who deserve much more attention especially outside of Italy. This diversity of international and methodological perspectives gives the volume its unique character. The book will be essential reading for academics working in the areas of Legal History, Law and Religion, and Constitutional Law and will appeal to scholars, lawyers, and students interested in the interplay between religion and law in the era of globalization.

This book was released on 2009-10-02 with total page 601 pages. Available in PDF, EPUB and Kindle. Book excerpt: The material contained in this publication is the outcome of the 8th International Conference on Human Rights "Right to Knowledge and Information in Heterogenic Society", organized by the Faculty of Law and Administration in the University of Warmia and Mazury in Olsztyn (Poland), in cooperation with the Faculty of Law in the University of Bari (Italy), which took place on 30-31 May 2008 in Olsztyn. The selection of issues in no respect can be called accidental. The summit of the European Council in Lisbon in March 2000 created foundations for creating society based on knowledge that is conscious in gaining information and equal access to knowledge. Individual actions of countries should aim at creating a human-friendly "information society" which allows creation of new working places and developing information and telecommunication technologies. This broad spectrum of problems which were the subject of the conference, interests not only Polish researchers but also scientists from countries like Italy, Spain, Ukraine, the United States of America, United Kingdom, and South Korea. They represent various cultures, which implies differences of opinion on many issues related to human rights. Publications included in this collective work are the reflection of freedom to express thoughts on difficult topics, which are important for all though.
