A ce titre, il intègre les considérations juridiques et interpelle plus précisément le droit public dans la mission de sécurité qui incombe aux autorités publiques. Mais le traitement juridique du risque dévoile vite plusieurs difficultés d'appréhension qui tiennent autant à l'identification précise du risque qu'à son encadrement proprement dit. Malgré la possibilité d'établir des constantes pour la notion de risque, il apparaît que son traitement n'est pas uniforme et rencontre des obstacles structurels qui en troublent la coherence. Ce phénomène s'est accentué avec l'apparition de nouveaux types de risques, issus du développement technologique, dont les mécanismes et les caractères échappent aux instruments et rationalités classiques de traitement. Dans ce contexte renouvelé, a émergé, puis s'est construit, le principe de précaution: nouvel instrument préventif contraignant, s'appliquant à la gestion des risques hypothétiques, jusque-là délaissés par le droit. Ce principe s'est greffé sur la notion de précaution qui lui préexistait dans le système juridique, remodelant substantiellement son contenu. Sa nature principielle, autant que son mécanisme original, ont occasionné une véritable instrumentalisation qui a révélé sa fertilité formelle et fonctionnelle et qui interroge l'ensemble du droit administratif: ses principes, ses modèles, ses structures, ses solutions. Sans exagérer son utilisation, qui demeure pour l'instant réservée et limitée, il s'avère que l'approche inédite des risques qu'il propose permet toutefois de repenser les constantes traditionnelles de l'action administrative pour en révéler les mutations et les nouvelles potentialités.

C'est au niveau de la conception du médicament que la philosophie du principe de précaution se trouve le plus en harmonie. Afin de mieux le caractériser, le principe de précaution peut être rapproché de la notion de précaution qui est présente depuis la nuit des temps en santé. "Primum non nocere" est la règle de conduite des professionnels de santé. Le principe de précaution, qui est une sorte d'outils dans la gestion des risques hypothétiques, renferme deux obligations: une obligation d'évaluation du risque et une obligation de prévention. S'il est doté d'une fonction préventive face au risque incertain, il n'est pas dépourvu d'une mission réparatrice.Son régime juridique concerne tant le droit public que le droit privé, et les juges ne peuvent plus ignorer ce principe perçu comme une clé pour l'avenir
