Book excerpt: La loi du 21 avril 1810 institue une "propriété minière", reconnue par l'Etat aux concessionnaires de mines. Cette propriété est originale et il s'agit d'une création contemporaine. Pour quelle raison le législateur a-t-il cru utile d'innover ? L'importance économique et politique des produits du sous-sol a très rapidement obligé la monarchie française à réglementer l'activité minière à son profit. Ce droit connaît alors d'importantes évolutions selon les moyens de contrainte de l'État : reposant sur une large part de liberté, en France et également en Dauphiné, il exige au fil du temps pour des hypothèses de plus en plus nombreuses une autorisation d'exploiter émanant de l'autorité royale. Cette « marche régalienne » est cependant ralentie par l'opposition des seigneurs, des propriétaires et des petits exploitants qui refusent la politique économique déterminée par l'administration royale. Le développement de cette dernière, à partir des années 1740, et l'invocation d'une rhétorique fondée sur le bien public, ne suffisent pas à vaincre cette résistance. Cette dernière débouche sur la loi du 28 juillet 1791, qui permet aux propriétaires d'exploiter les mines sises sur leurs fonds. Il faut attendre le Consulat, puis le premier Empire pour que soit abandonné le droit du propriétaire d'exploiter les mines sises dans son fonds. Contre la loi du 28 juillet 1791, 1'instruction du 18 messidor an IX et la loi du 21 avril 1810 marquent alors le terme de la formation du droit minier en France, avec l'affirmation des droits de l'État sur le sous-sol de manière incontestable, contre les droits des propriétaires, au moyen d'une propriété minière conditionnée par l'intérêt général.
