Sur le plan juridique, l'étranger, ne faisant pas partie de la société politique que compose l'état, a toujours fait l'objet, en droit français comme en droit comparé, d'un régime dérogatoire à celui applicable aux nationaux. La singularité de ce statut spécifique se manifeste en matière d'entrée et de séjour sur le territoire. Aucun étranger ne peut en effet entrer et séjourner sur le territoire national sans en avoir préalablement une autorisation qui est par essence précaire. L'ordonnance du 2 novembre 1945 relative aux conditions d'entrée et de séjour des étrangers en France, ne déroge pas à ce principe. Jusqu'en 1974, ce texte a fait l'objet d'une application libérale pour répondre aux intérêts de la croissance économique. Mais depuis la crise économique et le développement de l'immigration clandestine, ce texte fait l'objet d'une frénésie législative qui rend extrêmement complexe et illisible le régime de séjour de l'étranger. De surcroît, ces modifications tendent à rendre plus rigoureuses les conditions de séjour et plus faciles les moyens d'éloignement. L'examen de cette réglementation montre les limites des garanties dont dispose l'étranger face à l'administration toute puissance ; garanties qui ne cessent de régresser, pour les étrangers du droit commun, au fur et à mesure que la construction européenne avance. Dans le cadre de ce régime restrictif, le juge administratif essaie de protéger les droits des intéressés mais son action reste bien mesurée. Il est aujourd'hui supplée d'une part par le juge européen qui développe un contrôle bien protecteur des étrangers, et d'autre part par le conseil constitutionnel. Malgré la multiplicité des protecteurs des étrangers, un long chemin reste à faire en la matière.

A coté des normes traitant incontestablement, de par leur objet, de l’entrée et de séjour des étrangers, d’autres s’adressent, de prime abord, à toute personne résidant en France, sans condition de nationalité. Pourtant notamment dans le domaine du travail et des prestations sociales, un examen plus approfondi de ces textes révèle que leur application est subordonnée à une contrainte spécifique de résidence et surtout de régularité, renvoyant par la même à l’exigence d’un titre de séjour. En effet une nouvelle forme de migration est née : les femmes sont devenues des actrices incontournables dans le processus migratoire. Dans cette thèse, l’accent est mis sur l’exemple de la femme sénégalaise. Par ailleurs, en multipliant les réformes, législateur et gouvernement n’ont pas procédé à la refonte de l’ordonnance N° 45-2658 du 2 novembre 1945, qui progressivement, a perdu son unité originelle et une certaine vocation codificatrice. Certains articles, profondément démembrés, sont aujourd’hui difficilement lisibles (notamment art 35 bis, ter, et quater). Cette thèse d’inspiration doctrinale et jurisprudentielle, doit être comprise comme le recensement des normes de droit constitutionnelles, communautaires, conventionnelles, pénales, civiles, administratives, législatives, et réglementaires se rapportant à l’entrée et au séjour des étrangers en France, au départ forcé du territoire,à l’accès à la nationalité française et à l’asile politique.

Book excerpt: In the 1930s, the French Third Republic banned naturalized citizens from careers in law and medicine for up to ten years after they had obtained French nationality. In 1940, the Vichy regime permanently expelled all lawyers and doctors born of foreign fathers and imposed a 2 percent quota on Jews in both professions. On the basis of extensive archival research, Julie Fette shows in Exclusions that doctors and lawyers themselves, despite their claims to embody republican virtues, persuaded the French state to enact this exclusionary legislation. At the crossroads of knowledge and power, lawyers and doctors had long been dominant forces in French society: they ran hospitals and courts, doubled as university professors, held posts in parliament and government, and administered justice and public health for the nation. Their social and political influence was crucial in spreading xenophobic attitudes and rendering them more socially acceptable in France. Fette traces the origins of this professional protectionism to the late nineteenth century, when the democratization of higher education sparked efforts by doctors and lawyers to close ranks against women and the lower classes in addition to foreigners. The legislatively imposed delays on the right to practice law and medicine remained in force until the 1970s, and only in 1997 did French lawyers and doctors formally recognize their complicity in the anti-Semitic policies of the Vichy regime. Fette's book is a powerful contribution to the argument that French public opinion favored exclusionary measures in the last years of the Third Republic and during the Holocaust.

Book excerpt: This book, which draws on a rich array of primary sources and archival materials, offers the first major appraisal of French responses to the Jewish refugee crisis after the Nazi seizure of power in 1933. It explores French policies and attitudes toward Jewish refugees from three interrelated vantage points: government policy, public opinion, and the role of the French Jewish community. The author demonstrates that Jewish refugees in France were not treated in the same manner as other foreigners, in part because of foreign policy considerations and in part because Jewish refugees had a distinctive socioeconomic profile. By examining the socioeconomic and political factors that informed French refugee policy in the 1930's, the author presents overwhelming evidence that Vichy's anti-Jewish measures were not merely the work of a few antisemitic zealots in the administration, nor did they stem solely from the desire of Marshal Pétain's government to find scapegoats for the military defeat of 1940. Rather, they enjoyed widespread popular support, not only from far-right organizations but also from a host of middle-class professional associations and their members (doctors, lawyers, merchants, and artisans) who perceived Jews as a competitive threat. The author also sheds new light on Jewish political behavior in the 1930s. She demonstrates that the French Jewish community was sharply divided over the proper approach to the refugee crisis. While some Jewish leaders pressed for a hard-line policy, others worked assiduously to provide the refugees relief and to persuade the government to pursue a more liberal refugee policy. Thus the author refutes claims that the native French Jewish elite was overwhelmingly unsympathetic to the refugees because of fear that an influx of refugees would provoke an antisemitic backlash. While this book reveals the extent to which anti-refugee attitudes and policies in the 1930's paved the way for Vichy's anti-Jewish policies, it also highlights significant discontinuities between the refugee policies of the Third Republic and those of the Vichy regime.
