Book excerpt: Actuellement, l'espace audiovisuel de la radiodiffusion par satellite est régi au niveau européen par deux instruments émanant de deux organisations européennes différentes. Il s'agit de la Convention européenne sur la télévision transfrontière du Conseil de l'Europe et de la Directive de la Communauté européenne dite « télévision sans frontières ». L'étude présente d'abord les bases juridiques de ces deux instruments et compare ensuite leurs dispositions respectives. La complexité du domaine de la télévision transfrontière a obligé les deux institutions à se borner à réglementer les matières les plus urgentes : la détermination de la responsabilité juridique de l'Etat de diffusion, la réglementation de la publicité, la protection des mineurs et la garantie du droit de réponse. Néanmoins, malgré l'établissement de systèmes de contrôle propres à chaque instrument, l'application de ceux-ci ne s'est pas avérée des plus simples en raison, d'une part, des développements technologiques rapides intervenus dans le domaine de l'audiovisuel, et, d'autre part, des réticences propres des États à respecter les dispositions de ces instruments. Pour ces mêmes raisons, l'étude démontre qu'une révision de ces instruments s'impose si l'on veut assurer une réglementation effective de la diffusion des émissions par satellite en Europe. Enfin, l'étude conclut par l'examen d'un certain nombre de recours concernant l'application des dispositions de ces instruments qui ont été déposés devant la Cour de justice européenne.
