Des phénomènes tels que l’allongement de la durée de la vie, l’urbanisation des populations, la difficulté d’entrée sur le marché du travail ou encore l’éclatement des modèles familiaux traditionnels marquent notre monde contemporain et impliquent la disparition d’anciennes solidarités et l’apparition de nouvelles solidarités redessinant les relations entre générations, posant alors le problème du sort des personnes les plus fragiles : les enfants, les malades, les handicapés et, surtout, les personnes âgées. – Quel est alors le rôle de la famille et des collectivités dans la protection de ces personnes ? – Quels rapports entre solidarités publiques et solidarités privées ? – Quels sont les droits et libertés reconnus aux personnes que l’âge, la maladie ou le handicap, placent en situation de dépendances ? Telles sont les questions au cœur de cet ouvrage. The importance of the human, economic and social issues caused by the question of generations’ solidarities led the International Society of Family Law to choose this theme for its XVIth World Congress (Lyon, July 19-23rd 2011). More than 200 speakers from 50 countries studied these questions from the legal angle, but also philosophic, economic and anthropological. This work collects a part of these papers about two great issues: the child, as the center of family solidarities; and the support for elders by family. Phenomena such as increasing life expectancy, population urbanization, labor-market entry barriers, decline of traditional family patterns, mark in depth our contemporary world and involve old solidarity disappearance and new solidarity emergence, reshaping relations between generations while bringing up the problem of the fate of the most vulnerable: children, the sick, disabled, and especially elderly people. – What then is the role of families and communities in protecting these people? – What is the relationship between public and private solidarity? – What are the rights and freedoms of people placed by age, illness or disability in a dependence situation? These are the issues addressed by the authors of this book.

It entered into force in February 1989 and all 47 member States are Parties to the Convention. The Convention has already established itself as an important human rights instrument. Its approach is quite different from that of the European Convention on Human Rights. Whereas the ECHR provides a remedy for particular human rights violations after the event, the Convention for the Prevention of Torture (ECPT) seeks to prevent human rights violations, through a system of visits to places of detention. The Convention is intended to be an integrated part of the Council of Europe system for the protection of human rights, placing a proactive non-judicial mechanism alongside the reactive judicial mechanism established under the ECHR. Book excerpt: Devant une situation de refus de soins, le médecin doit tenir compte 1/ au niveau clinique : du motif du refus de soins, de l’évaluation du jugement et de la capacité à consentir (signes de gravité clinique, insight et retentissement sur la qualité de vie) ; 2/ au niveau juridique : de sa responsabilité et de ses obligations vis-à-vis du patient (droit à l’information, au consentement et au refus de soins éclairé) ; la jurisprudence permet d’illustrer la manière dont certaines situations juridiques ambiguës ont été résolues ; 3/ au niveau éthique : des principes éthiques fondamentaux (non-malfaisance, bienfaisance, autonomie et dignité) ; 4/ de la balance bénéfice-risque : la délibération confronte des principes susceptibles de s’opposer les uns aux autres ; dans certaines situations (cas de la non-assistance à personne en danger) tous les principes ne peuvent pas être respectés simultanément. La problématique du refus de soins non psychiatrique (loi du 4 Mars 2002) est largement complexifiée dans les situations de soins psychiatriques sans consentement (SPSC) puisque le patient est alors hospitalisé au motif de « troubles mentaux qui rendent impossible son consentement » (loi du 5 Juillet 2011 modifiée le 27 Septembre 2013). Dans ce contexte, que nous illustrons ici d’une série de cas cliniques, le médecin doit impérativement doser les actions nécessaires à la sauvegarde de la dignité du patient (principe de proportionnalité). Il doit veiller à la protection de celui-ci sans nier totalement sa personne. Dans les situations extrêmes (notamment lorsqu’il existe un risque vital immédiat pour la personne), l’intérêt direct du patient (l’expression de sa volonté) peut être sacrifié au bénéfice d’un intérêt indirect (sa survie). En conclusion, les situations de refus de soins non psychiatriques dans les situations de SPSC sont complexes et nécessitent une réflexion clinique, juridique et éthique. La notion de balance bénéfice-risque oriente une décision qui doit être collégiale et tracée dans le dossier médical du patient. Les futurs travaux dans le domaine devront favoriser une prise en compte graduée du consentement et le développement élargi des directives anticipées chez les patients hospitalisés en SPSC.

Marcel Gauchet and Gladys Swain maintain that the asylum originally embodied the revolutionary hope of curing all the insane by saving the glimmer of sanity left in them. Their analysis of why this utopian vision failed ultimately constitutes both a powerful argument for liberalism and a direct challenge to Michel Foucault's indictment of liberal institutions. The creation of an artificial environment was meant to encourage the mentally ill to live as social beings, in conditions that resembled as much as possible those prevailing in real life. The asylum was therefore the first instance of a modern utopian community in which a scientifically designed environment was supposed to achieve complete control over the minds of a whole category of human beings. Gauchet and Swain argue that the social domination of the inner self, far from being the hidden truth of emancipation, represented the failure of its overly optimistic beginnings. Madness and Democracy combines rich details of nineteenth-century asylum life with reflections on the crucial role of subjectivity and difference within modernism. Its final achievement is to show that the lessons learned from the failure of the asylum led to the rise of psychoanalysis, an endeavor focused on individual care and on the cooperation between psychiatrist and patient. By linking the rise of liberalism to a chapter in the history of psychiatry, Gauchet and Swain offer a fascinating reassessment of political modernity.

Nevertheless, this report also identifies weaknesses in Europe, some systematic, such as a lack of consensus on definitions, and of compatible data collection, and others such as the need for development and investment across several areas. It identifies gaps in information where further work must be done, and is a baseline against which progress can be measured towards the vision and the milestones of the Mental Health Declaration for Europe. The data were obtained from the ministries of health of 42 European Member States. Over 150 figures and tables in the report demonstrate the diversity across the European Region, and allow country to country comparisons of indicators such as numbers of psychiatrists, financing, community services, training of the workforce, the prescription of anti-depressants and representation of users and carers.
