Book excerpt: Les ententes d'autonomie et de revendications territoriales globales conclues entre l'État canadien et certaines nations autochtones ont notamment recours au principe de personnalité des lois pour concrétiser le partage du pouvoir entre eux. Le principe de personnalité, lequel rattache l'application des lois aux individus sur le fondement de critères identitaires, est reconnu pour répondre aux revendications d'autonomie de groupes minoritaires peu populeux, dispersés ou en situation de peuplement composite. Malgré le fait que de nombreux peuples autochtones soient confrontés à de telles situations, des doutes subsistent chez certains auteurs concernant la pertinence de retenir ce principe pour répondre aux revendications d'autonomie des peuples autochtones. Ce principe serait, de l'avis de ces auteurs, incapable de rencontrer la volonté de ces peuples de préserver et de valoriser les liens juridiques multiséculaires qu'ils entretiennent avec leurs terres. En d'autres termes, on se demande s'il ne s'agit pas là d'un mécanisme néocolonial. Après une étude des concepts de souveraineté inhérente autochtone, de territorialité et de personnalité des lois et du principe d'autonomie, la thèse présente les singularités juridiques du principe de personnalité des lois et met en exergue ses effets sur l'autonomie des nations signataires de six ententes de revendications territoriales globales et d'autonomie gouvernementale. La description et l'analyse des dispositifs d'aménagement des particularités du principe de personnalité dans ces ententes font ensuite place à une critique de ces dispositifs au regard du principe d'autonomie. Cette analyse critique nous amène à conclure qu'à certaines conditions, le principe de personnalité des lois peut être un mécanisme favorisant l'émancipation des peuples autochtones. Cela dit, ce principe est loin d'avoir été utilisé à son plein potentiel autonomique au Canada. La thèse se conclut par une évaluation comparative des ententes et par des recommandations.
