Available in PDF, EPUB and Kindle.

Book excerpt: Never before in the history of mankind has there been a period when hitherto accepted moral principles have been more severely tested. The agonized cry of a world smitten by two major wars in a handful of years leaves no doubt in the minds of many that natural law ethics, ifit is to have relevance and to survive, must provide at least the outline of an answer to the problems of every day living. To date, many hundreds of books and articles have been written setting forth with great eloquence the basic and immutable principles of natural law ethics. But too often these discussions fail to consider, in their agonizing detail, situations where there is a choice between conflicting values, conflicting loyalties, conflicting ideas and duties, each of which has a claim to recognition. It is only in the isolation of the particular case that the frightening dilemmas of natural law can be most clearly experienced. To give just two illustrations.

Book excerpt: In this comprehensive anthology, twenty-seven outstanding scholars from North America and Europe address every major aspect of Thomas Aquinas's understanding of morality and comment on his remarkable legacy. While there has been a revival of interest in recent years in the ethics of St. Thomas, no single work has yet fully examined the basic moral arguments and content of Aquinas' major moral work, the Second Part of the Summa Theologiae. This work fills that lacuna. The first chapters of The Ethics of Aquinas introduce readers to the sources, methods, and major themes of Aquinas's ethics. The second part of the book provides an extended discussion of ideas in the Second Part of the Summa Theologiae, in which contributors present cogent interpretations of the structure, major arguments, and themes of each of the treatises. The third and final part examines aspects of Thomistic ethics in the twentieth century and beyond. These essays reflect a diverse group of scholars representing a variety of intellectual perspectives. Contributors span numerous fields of study, including intellectual history, medieval studies, moral philosophy, religious ethics, and moral theology. This remarkable variety underscores how interpretations of Thomas's ethics continue to develop and evolve-and stimulate fervent discussion within the academy and the church. This volume is aimed at scholars, students, clergy, and all those who continue to find Aquinas a rich source of moral insight.

Available in PDF, EPUB and Kindle. Book excerpt: In this final edition of his classic study of St. Thomas Aquinas, Etienne Gilson presents the sweeping range and organic unity of Thomistic philosophical thought. Gilson demonstrates that Aquinas drew from a wide spectrum of sources in the development of his thought—from Aristotle, to the Arabic and Jewish philosophers of his time, as well as from Christian writers. What results is an insightful introduction to the thought of Aquinas and the Scholastic philosophy of the Middles Ages. Praise for The Christian Philosophy of St. Thomas Aquinas “As the only English version of any edition of Le Thomisme, and therefore for years a kind of manual for North American students approaching Aquinas, the book deserves recirculation. With it appears the masterful ‘Catalogue of St. Thomas’ works’ prepared by the Rev. I. T. Eschmann to accompany Shook's translation and available nowhere else. . . . Its overview of principles and conclusions in the history of the texts has not been surpassed.”—The Philosophical Quarterly “[This volume presents] L. K. Shook's English translation of the final version of the late Etienne Gilson's (1884-1978) classic overview of the Christian philosophy of St. Thomas Aquinas. . . . Gibson was one of the pioneers, in the early part of [the twentieth] century, of medieval philosophy in general and the work of Aquinas in particular. He sought to restore the study of Aquinas’ texts an historical sensitivity, thus rescuing them from the near canonical status accorded in the well-intentioned but inhabiting late nineteenth-century palpal revival of Thomistic studies and preserved in the so-called ‘manual theology’ of the seminar curriculum. . . . The endnotes are an invaluable resource, as is the still unsurpassed catalogue of Aquinas’ works compiled by Eschmann and included as an invaluable appendix here.”—Theological Book Review

Book excerpt: It has more than once been observed that funeral orations for the natural law have always been premature. ! The implication that the concept has a continuing vitality, giving the lie to the prophets of its doom, is justification for yet another book on a subject, now as much as ever in the two and a half millenia of its history a matter of controversy. The history of the natural law has often been written -or at least the history of the concept in the Western European Greco 2 Roman tradition. This study does not claim to be a history, although its method is primarily historical and its subject is an idea that, more perhaps than most, has been shaped by its history. The omissions, Hobbes, Vico, Kant, Hegel for example, amply demonstrate that this is not a systematic history. On the other hand it accepts that In an orderly preparation for the study of natural law the most impor tant step would be to list the main modifications undergone by the notion of natural law as a result of doctrinal and historical cir cumstances? 1 Bergbohm, Jurisprudenz und Rechtsphilosophie, cited in a. M. Manser, Vas Natu"echt in Thomistischer Beleuchtung, p. 1; cf. A. P. d'Entreves, Natural Law, p. 13: "It was declared dead, never to rise again from its ashes. Yet natural law has survived and still calls for discussion. " 2 A.

On the one hand, the connection of international law and religion has been little explored. On the other, most of current research on international legal thought presents international law as the very victory of secularization. By questioning that narrative of secularization this book approaches these traditions from a new perspective. From the Middle Ages' early conceptualizations of rights and law to contemporary political theory, the chapters bring to life debates concerning the interaction of the meaning of the legal and the sacred. The contributors approach their chapters from an array of different backgrounds and perspectives but with the common objective of investigating the mutually shaping relationship of religion and law. The collaborative endeavour that this volume offers makes available substantial knowledge on the question of international law and religion.

Written anonymously at the end of the Year Book period, the Discourse Upon the Exposicion and Understandinge of Statutes is the earliest English treatise on the subject. Thorne's edition has the additional appeal of lengthy manuscript notes compiled from a copy owned by Sir Thomas Egerton [?1540-1617], an attorney who held several important posts in Elizabethan England including Solicitor-General and Lord Chancellor. "Professor Thorne ... has carried out his difficult task with great skill and has prefixed an introduction which can be regarded as the most authoritative and most richly documented discussion as yet upon the problems of statutory interpretation from the later fourteenth century ... to the age of Coke." Available in PDF, EPUB and Kindle. Book excerpt: Statistics on the American family are sobering. From 1975 to 2000, one-third of all children were born to single mothers, and one-half of all marriages ended in divorce. While children from broken homes are two to three times more likely to develop behavioral and learning difficulties, two-parent families are not immune to problems. The cost of raising children has increased dramatically, and married couples with children are now twice as likely as childless couples to file for bankruptcy. Clearly, the American family is in trouble. But how this trouble started, and what should be done about it, remain hotly contested. In a multifaceted analysis of the current state of a complex institution, Family Transformed brings together outstanding scholars from the fields of anthropology, demography, ethics, history, law, philosophy, primatology, psychology, sociology, and theology. Demonstrating that the family is both distinctive in its own right and deeply interwoven with other institutions, the authors examine the roles of education, work, leisure, consumption, legal regulation, public administration, and biology in shaping the ways we court and marry, bear and raise children, and make and break family bonds. International in approach, this wide-ranging volume situates current American debates over sex, marriage, and family within a global framework. Weighing mounting social science evidence that supports a continued need for the nuclear family while assessing the challenges posed by new advocacy for same-sex marriage, and delegalized coupling, the authors argue that only by reintegrating the family into a just moral order of the larger community and society can we genuinely strengthen it. This means not simply upholding traditional family values but truly grasping the family's growing diversity, sustaining its coherence, and protecting its fragility for our own sake and for the common good of society.

Book excerpt: This innovative, interdisciplinary book reconstructs the career of Genesis 1:28 ("Be fertile and increase, fill the earth and master it...") in Judaism and Christianity, from antiquity through the Reformation. Jeremy Cohen tracks the text through all the Jewish and Christian sources in which it figures significantly—in law, exegesis, homily, theology, mysticism, philosophy, and even vernacular poetry. In his view, the verse situates man and woman on a cosmic frontier, midway between the angelic and the bestial, charging them with singular responsibilities that bear directly on Jewish and Christian ideas of God's "chosen people."

Smith provides a revisionist account of the scholastic culture that flourished in Paris during the High Middle Ages. Exploring the educational culture that informed the intellectual and mental habits of Thomas Aquinas and Bonaventure, he offers an in-depth study of the prologues and preaching skills of these two masters. Smith reveal the intricate interrelationships between the three duties of the master: lectio (reading), disputatio (debate), and praedicatio (preaching). He also analyzes each of Aquinas and Bonaventure's prologues from their student days to their final works, revealing both their artistry and their instructional character. Written in an engaging style, this book serves as an invaluable resource that will enable scholars and students to read thirteenth-century sermons, prologues, and biblical commentaries with greater understanding and ease.
