Book excerpt: Au premier abord, l'évocation d'un droit fondamental au séjour en faveur des étrangers apparaît surprenante puisque en totale rupture avec, d'une part, la rigueur de la politique nationale d'immigration et, d'autre part, les solutions de droit positif s'accordant, à la fois, pour nier l'existence d'un tel droit et pour inscrire la problématique du séjour de l'étranger dans une logique de souveraineté. Néanmoins, parmi les droits fondamentaux dont bénéficient les étrangers, certains d'entre eux sont aptes à s'opposer à la mise en oeuvre des mesures de police, et à drainer dans le sillage de leur protection, une garantie pour le séjour des étrangers. A travers leur exercice, les étrangers sont ainsi dotés de la capacité d'entrer sur le territoire d'immigration ou encore d'y rester, malgré l'édiction d'une mesure d'éloignement. Le droit fondamental au séjour ainsi révélé n'est cependant jamais autonome. Il est le fruit d'un mécanisme de médiation étant donné qu'il existe uniquement à travers l'application d'autres droits fondamentaux. Il faut toutefois constater que l'incidence des droits fondamentaux des étrangers sur leur séjour ne saurait aboutir à une quelconque assimilation avec les membres de la communauté nationale. Le régime des droits fondamentaux des étrangers demeure en confrontation permanente avec la logique de souverainete, laquelle est toujours prompte à resurgir, et à entourer le séjour des non-nationaux. Au final, seul un nombre restreint d'étrangers pourra prétendre au bénéfice du droit au séjour. Et, lorsque le séjour est de droit, les étrangers n'ont aucune garantie de se voir attribuer un titre de séjour. En d'autres termes, aucun droit à la régularité du séjour n'est automatiquement associé au droit de demeurer sur le territoire d'immigration. La logique de droits contraint assurément la liberté d'action des pouvoirs publics. Mais elle ne la fait en aucun cas disparaître.
