Book Synopsis Space Insurance: International Legal Aspects by : Katarzyna Malinowska
Download or read book Space Insurance: International Legal Aspects written by Katarzyna Malinowska and published by Kluwer Law International B.V.. This book was released on 2017-03-15 with total page 342 pages. Available in PDF, EPUB and Kindle. Book excerpt: Insurance related to outer space activities has been around since the 1960s, but has become vastly more significant with the increased commercial use of satellites. This book focuses on the legal aspects of space insurance in the contractual context, analysing space risk as well as the insurance terms used on the market. It offers the first in-depth coverage, both practical and theoretical, of space insurance from an international law perspective. Attending throughout to the important and problematic distinction between the space segment (upstream) and ground segment (downstream) in space law, this book deals comprehensively with such issues and topics as the following: - the main hazards relating to space activities; - the impact of new space technologies on the level of risk and insurance; - the differing types of risks attributable to various entities in the context of insurable interest; - aspects of the space risk allocation regimes and risk assessment; - the impact of the five ‘space treaties’ – the Outer Space Treaty, the Liability Convention, the Rescue Agreement, the Registration Convention and the Moon Agreement – on the subject and scope of insurance coverage; - the advent of suborbital flight, commercial human space flight and space tourism in the context of emerging insurance risks; - the problem of space debris; - contractual aspects of space activities affecting the space insurance risks; - basic notions such as ‘outer space’, ‘space object’ in the context of space activities and related insurance coverage; - basic insurance principles and their operation in the space insurance; and - the adjustment of losses and the settlement of disputes in space insurance. The author emphasises the need to understand the various insurance risks facing particular types of commercial space activities, including pre-launch, launch, transportation, spaceflight, satellite communications, satellite navigation, satellite remote sensing and space station operation. Satellites are increasingly a vital part of many daily activities of contemporary society and the Earth’s orbit is becoming ever more crowded, heightening the risks of collision, damage and claims. This thoroughly researched book will therefore be extremely useful to lawyers, policymakers and academics tasked with defining the scope of insurance coverage that accurately mirrors technological, contractual and legal reality. Its practical aspect will be of extraordinary value to insurance lawyers, underwriters and brokers.
Book Synopsis National Space Legislation in Europe by : Frans G. von der Dunk
Download or read book National Space Legislation in Europe written by Frans G. von der Dunk and published by BRILL. This book was released on 2011-09-09 with total page 413 pages. Available in PDF, EPUB and Kindle. Book excerpt: The increasing involvement of private enterprise in the conduct of space activities raises key issues with respect to international space law which has left it to national law to implement relevant rules vis-à-vis private enterprise. Almost unavoidably, such national implementation regimes differ largely across individual states. This is also true in Europe, where the issue is further compounded by the fundamental – but fundamentally different – roles of ESA and the European Union. Focusing on Europe, the present book thus represents the first comprehensive effort to discuss national authorisation schemes not country by country but theme by theme, so as to allow for a real comparison of the lack of harmonisation or even coordination, and the possible problems which may result.
Book Synopsis Spaceports in Europe by : Annette Froehlich
Download or read book Spaceports in Europe written by Annette Froehlich and published by Springer Nature. This book was released on 2022-01-01 with total page 156 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores how Europe is seeking to enlarge its launching capacities by building additional spaceports on the European continent. Various national initiatives are envisaged resulting in a “space race” in the field of constructing spaceports and building micro launchers. However, right from the beginning when choosing the launch site (land or sea based-rocket launches) there are various factors relating to international space law, European regulations and national rules that must be considered, as spaceports are rarely explicitly addressed in current legal and policy frameworks. While launching sites used to be operated by governments, private commercial initiatives are increasingly entering the field. This paradigm shift must be reflected within regulations relating to various aspects of space liability by enlarging the long-established terms of the United Nations space treaties to accommodate commercial space flights. Questions of permission, supervision and control require special liability regulations to avoid detrimental consequences stemming from the concept of “launching states” in view of the rise of private driven commercial space activities on a global level. Furthermore, not only do environmental aspects need to be thoroughly examined but also the concept of critical infrastructure requires special attention from a security perspective to anticipate, inter alia, cyber-attacks. For these reasons, several European and national regulations may need to be enlarged to apply to the entire space sector, using a harmonized approach that has direct implications for the regulations, programmes, and missions of the European Union and the European Space Agency, bearing in mind that the upcoming spaceports in Europe are an essential asset to substantially boost the European New Space.

Book Synopsis The European Landscape Convention by : Michael Jones
Download or read book The European Landscape Convention written by Michael Jones and published by Springer Science & Business Media. This book was released on 2011-02-09 with total page 327 pages. Available in PDF, EPUB and Kindle. Book excerpt: This important and insightful book provides, for the first time, a broad presentation of ongoing research into public participation in landscape conservation, management and planning, following the 2000 European Landscape Convention which came into force in 2004. The book examines both the theory of participation and what lessons can be learnt from specific European examples. It explores in what manner and to what extent the provisions for participation in the European Landscape Convention have been followed up and implemented. It also presents and compares different experiences of participation in selected countries from northern, southern, eastern and western Europe, and provides a critical examination of public participation in practice. However, while the book’s focus is necessarily on Europe, many of the conclusions drawn are of global relevance. The book provides a valuable reference for researchers and advanced students in landscape policies and management, as well as for professionals and others interested in land-use planning and environmental management.

Book Synopsis The Law of Outer Space by : Tanja L. Masson-Zwaan
Download or read book The Law of Outer Space written by Tanja L. Masson-Zwaan and published by BRILL. This book was released on 2010-09-10 with total page 186 pages. Available in PDF, EPUB and Kindle. Book excerpt: It is a remarkable achievement to write a book that almost four decades after its publication has lost virtually none of its relevance. Manfred Lachs’ famous treatise on the Law of Outer Space was originally published in 1972, yet it is still a classic and must-read text for space law students today, even though copies can nowadays be rarely found. The reissue of this remarkable work is therefore timely indeed. Its aim is to make the brilliance, foresight and clarity of Lachs’ thinking once more easily accessible to a new generation of scholars. Issued on the occasion of the 50th anniversary of the International Institute of Space Law, of which Lachs was President, this volume reproduces the original text of Lachs' work in full, with a new preface, introduction and index supplied by the editors.
Book Synopsis Governing Africa's Forests in a Globalized World by : Laura Anne German
Download or read book Governing Africa's Forests in a Globalized World written by Laura Anne German and published by Routledge. This book was released on 2009-12-01 with total page 435 pages. Available in PDF, EPUB and Kindle. Book excerpt: Many countries around the world are engaged in decentralization processes, and most African countries face serious problems with forest governance, from benefits sharing to illegality and sustainable forest management. This book summarizes experiences to date on the extent and nature of decentralization and its outcomes - most of which suggest an underperformance of governance reforms - and explores the viability of different governance instruments in the context of weak governance and expanding commercial pressures over forests. Findings are grouped into two thematic areas: decentralization, livelihoods and sustainable forest management; and international trade, finance and forest sector governance reforms. The authors examine diverse forces shaping the forest sector, including the theory and practice of decentralization, usurpation of authority, corruption and illegality, inequitable patterns of benefits capture and expansion of international trade in timber and carbon credits, and discuss related outcomes on livelihoods, forest condition and equity. The book builds on earlier volumes exploring different dimensions of decentralization and perspectives from other world regions, and distills dimensions of forest governance that are both unique to Africa and representative of broader global patterns. The authors ground their analysis in relevant theory while drawing out implications of their findings for policy and practice.
