Notamment, les professionnels ont rapidement découvert dans l'internet une nouvelle méthode de commercialisation. Toutefois, en raison de l'éloignement géographique et de son aspect ludique, les consommateurs contractant par ce biais ne perçoivent pas toujours la portée exacte de leur engagement. Cet état de fait a suscité une réaction législative, tant communautaire que nationale. Les contrats à distance conclus par les consommateurs sont ainsi régis par le Code de la consommation, alors que la loi pour la confiance dans l'économie numérique fournit un cadre juridique aux contrats conclus par la voie électronique. Cet état du droit positif présente néanmoins des lacunes et imperfections. Lacunes parce que les contrats à distance, simples modalités particulières de contracter disparates de par la diversité des techniques de communication à distance, ne font l'objet d'aucune réglementation lorsqu'ils sont conclus entre professionnels ou entre particuliers. Imperfections parce que le régime de droit de la consommation présente des divergences injustifiées par la nature de la prestation fournie. L'objet de l'étude n'est pas seulement de corriger ces lacunes et imperfections. Il s'agit à l'inverse de démontrer que le contrat à distance est un genre contractuel, caractérisé par un critère juridique dénommé la distance contractuelle, et par un régime propre tant en droit commun qu'en droit de la consommation.

Progressivement, la référence au concept civiliste de contrat de louage de service a été remplacée par l'appellation « contrat de travail ». Au début du XXe siècle, utiliser la notion de contrat de travail devient un premier pas pour s'extraire des concepts civilistes et pour commencer à protéger les travailleurs face aux abus des employeurs. Le salarié du XXIe siècle se caractérise tant dans sa relation avec l'employeur que par sa propre personnalité. C'est pourquoi il convient dans une première partie d'aborder la relation contractuelle au XXIe siècle fondée sur une conception classique du salarié sous l'autorité de son employeur, pour dans une seconde partie aborder la conception moderne du salarié du XXIe siècle en quête d'autonomie.
