Que serait aujourd'hui le fonctionnement du secteur de l'économie numérique ou bien celui des travaux publics sans la certitude que les réseaux et les infrastructures véhiculant les services qu'ils offrent sont susceptibles de faire face à toutes les agressions extérieures dont ils peuvent être l'objet ? Et comment pourrait-on l'affirmer si l'on n'avait pris toutes les précautions qu'une telle situation requiert dans les contrats qui ont permis leur édification ? Tel est l'objet de la présente thèse : montrer que le contrat administratif est "résilient" au sens où il fait face aux aléas qui peuvent l'affecter, s'y adapte, y résiste, les anticipe et mieux, les intègre. L'originalité du contrat administratif repose notamment sur l'existence de principes d'ordre public et de mécanismes juridiques permettant à ce dernier de répondre à l'aléa et d'assurer ainsi sa stabilité face à la contingence. Ainsi, les deux premiers critères de la résilience paraissent satisfaits : l'adaptation et la résistance à l'aléa. Or, l'évolution du contexte dans lequel se trouvent conclus les contrats administratifs ainsi que l'influence des principes fondamentaux relevant de l'ordre public concurrentiel révèlent l'insuffisance de ces mécanismes. Sans que ces derniers ne disparaissent pour autant, de nouvelles solutions complémentaires des premières ont donc dû être développées. La prévention se trouve alors progressivement placée au coeur du contrat administratif. Elle y dévoile la présence des deux autres critères de la résilience à savoir l'anticipation et l'assimilation de l'aléa. Ainsi, la satisfaction des quatre critères de la résilience par le contrat administratif semble non seulement faire émerger un nouveau concept de "contrat administratif résilient" mais participe aussi à faire de ce dernier un contrat plus air et moins singulier.

Book excerpt: Belgium has a unique place in the history of migration in that it was the first among industrialized nations in Continental Europe to develop into an immigrant society. In the nineteenth century Italians, Jews, Poles, Czechs, and North Africans settled in Belgium to work in industry and commerce. They were followed by Russians in the 1920s and Germans in the 1930s who were seeking a safe haven from persecution by totalitarian regimes. In the nineteenth century immigrants were to a larger extent integrated into Belgian society: they were denied political rights but participated on equal terms with Belgians in social life. This changed radically in the twentieth century; by 1940 the rights of aliens were severely curtailed, while those of Belgian citizens, in particular in the social domain, were extended. While the state evolved into a "welfare state" for its citizens it became more of a police state for immigrants. The state only tolerated immigrants who were prepared to carry out those jobs that were shunned by the Belgians. Under the pressure of public opinion, an exception was made in the cases of thousands of Jewish refugees that had fled from Nazi Germany. However, other immigrants were subjected to harsh regulations and in fact became the outcasts of twentieth-century Belgian liberal society. This remarkable study examines in depth and over a long time span how (anti-) alien policies were transformed, resulting in an illiberal exclusion of foreigners at the same time as democratization and the welfare state expanded. In this respect Belgium is certainly not unique but offers an interesting case study of developments that are characteristic for Europe as a whole.

Book excerpt: Fiscal Disobedience represents a novel approach to the question of citizenship amid the changing global economy and the fiscal crisis of the nation-state. Focusing on economic practices in the Chad Basin of Africa, Janet Roitman combines thorough ethnographic fieldwork with sophisticated analysis of key ideas of political economy to examine the contentious nature of fiscal relationships between the state and its citizens. She argues that citizenship is being redefined through a renegotiation of the rights and obligations inherent in such economic relationships. The book centers on a civil disobedience movement that arose in Cameroon beginning in 1990 ostensibly to counter state fiscal authority--a movement dubbed Opération Villes Mortes by the opposition and incivisme fiscal by the government (which for its part was eager to suggest that participants were less than legitimate citizens, failing in their civic duties). Contrary to standard approaches, Roitman examines this conflict as a "productive moment" that, rather than involving the outright rejection of regulatory authority, questioned the intelligibility of its exercise. Although both militarized commercial networks (associated with such activities trading in contraband goods including drugs, ivory, and guns) and highly organized gang-based banditry do challenge state authority, they do not necessarily undermine state power. Contrary to depictions of the African state as "weak" or "failed," this book demonstrates how the state in Africa manages to reconstitute its authority through networks that have emerged in the interstices of the state system. It also shows how those networks partake of the same epistemological grounding as does the state. Indeed, both state and nonstate practices of governing refer to a common "ethic of illegality," which explains how illegal activities are understood as licit or reasonable conduct.
