Book excerpt: Excerpt from Prentice-Hall Tax Service for 1919 This allowance is not based upon the difference between the actual war cost of such facilities and what they would have cost at pre-war prices. Obviously the taxpayer is not entitled to recover or extinguish through amortization more than the difference between the war cost of such property and what he can sell the property for after the war, or if he continues to need and use it in his business, what it would have cost him after the war. As the rule is expressed in Article 183 of the Regulations: The total amount to be extinguished by amortization, in general, is the excess of the unextinguished or unrecovered cost of the property over its maximum value (either for sale or for use as part of the plant or equipment of a going business) under stable post war. Book excerpt: Intellectual property (IP) law operates with the ontological assumption that immaterial goods such as works, inventions, and designs exist, and that these abstract types can be owned like a piece of land. Alexander Peukert provides a comprehensive critique of this paradigm, showing that the abstract IP object is a speech-based construct, which first crystalised in the eighteenth century. He highlights the theoretical flaws of metaphysical object ontology and introduces John Searle's social ontology as a more plausible approach to the subject matter of IP. On this basis, he proposes an IP theory under which IP rights provide their holders with an exclusive privilege to use reproducible 'Master Artefacts.' Such a legal-realist IP theory, Peukert argues, is both descriptively and prescriptively superior to the prevailing paradigm of the abstract IP object. This work was originally published in German and was translated by Gill Mertens.

Available in PDF, EPUB and Kindle. Book excerpt: If the physical constants, initial conditions, or laws of nature in our universe had been even slightly different, then the evolution of life would have been impossible. This observation has led many philosophers and scientists to ask the natural next question: why is our universe so "fine-tuned" for life? The debates around this question are wide-ranging, multi-disciplinary, complicated, technical, and (at times) heated. This study is a comprehensive investigation of these debates and the many metaphysical and epistemological questions raised by cosmological fine-tuning. Waller’s study reaches two significant and controversial conclusions. First, he concludes that the criticisms directed at the "multiverse hypothesis" by theists and at the "theistic hypothesis" by naturalists are largely unsuccessful. Neither of these options can plausibly be excluded. Choosing between them seems to turn on primitive (and so hard to justify) metaphysical intuitions. Second, in order to break the philosophical deadlock, Waller moves the debate from the level of universes to the level of possible worlds. Arguing that possible worlds are also "fine-tuned" in an important and interesting sense, Waller concludes that the only plausible explanation for the fine-tuning of the actual world is to posit the existence of some kind of "God-like-thing."

Available in PDF, EPUB and Kindle. Book excerpt: Foundations of Property Law: Things as Objects of Property Rights is an abridged translation of the first volume of Christian von Bar's Gemeineuropäisches Sachenrecht -a milestone in European private law theory, and in comparative property law more broadly. Radical in content and scope, the English version examines the dynamics of interaction between the objects, contents, and holders of property. The conceptual framework of 'property law' is presented as a domain of erga omnes monopoly rights that govern the relationship between persons and objects of value. Within that framework, a reciprocal relationship is illustrated between "property rights" and their objects; property rights play a role in constituting the very objects ("things") in which they are held. With comprehensive comparative analysis, insights are gleaned from all the jurisdictions of the European Union and the United Kingdom, presenting a critical evaluation of property law systems in both Common and Civil Law traditions. This book joins all the national legal systems in a single inquiry, treating their traditions and arguments with the respect they deserve and taking advantage of the knowledge embodied in the diversity of European private law. A scholastic work, offering deep and unique insights into the European property law systems, Foundations of Property Law will quickly become a go-to resource for anyone interested in European private law and comparative property law.

Book excerpt: Are legal concepts of intellectual property and copyright related to artistic notions of invention and originality? Do literary and legal scholars have anything to learn from each other, or should the legal debate be viewed as separate from questions of aesthetics? Bridging what are usually perceived as two distinct areas of inquiry, this interdisciplinary volume begins with a reflection on the "origins" of literary and legal questions in the Enlightenment to consider their ramifications in the post-Enlightenment and contemporary world. Tying in to the growing scholarly interest in connections between law and literature, on the one hand, and to the contemporary interrogation of "originality" and "authorship," on the other hand, the present volume furthers research in the field by providing a dense study of the legal and historical context to re-examine our current assumptions about supposed earlier Enlightenment and Romantic ideals of individual authorship and originality.

Book excerpt: The Internet has often been labeled a disruptive technology, and nowhere has that been more clearly the case than in the field of intellectual property (IP) law. Although debates over IP policy have raged in academic circles and law and economics journals for decades, with the rise of the Internet, IP issues have captured the public's collective attention like never before. Suddenly, the teenage creator of file-swapping sensation Napster appeared on the cover of Time magazine as the mass media took notice of an explosion of interest in digital downloads, CD burning, and widespread peer-to-peer file sharing among the general public. But the mass movement to share songs and other digital content online was met with a firestorm of criticism from copyright and patent holders, who struck back with a vengeance, filing lawsuits and pursuing legislative and regulatory remedies for what they regarded as intellectual property piracy on a scale never before envisioned. This debate has sparked a newfound interest in timeless questions about the nature of intellectual property and how it should be protected, including why do we protect intellectual property at all; do we really have "property rights" in our intangible creations the same way we have property rights to our homes and our land; aren't there better ways to encourage artistic creation and scientific discovery than through the use of copyright and patent laws that protect a limited monopoly? Copy Fights presents a thought-provoking exploration of these questions.
