Download or read book The Socialist Republic of Vietnam and the Law of the Sea written by Epsey Cooke Farrell and published by BRILL. This book was released on 2021-09-27 with total page 366 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Socialist Republic of Vietnam and the Law of the Sea analyzes Vietnam's policies on the law of the sea in relation to the country's overall foreign policy goals and its position at the center of the South China Sea geostrategic region. It examines Vietnam's claims in zones of maritime jurisdiction and its regulation of maritime activities in the context of the 1982 U.N. Convention on the Law of the Sea and against the backdrop of Vietnam's security interests, economic development, and regional leadership goals. The author explores Vietnam's maritime boundary disputes with its Southeast Asian neighbors and China and assesses their impact on regional stability. This is the first comprehensive study to trace the evolution of Vietnamese policy and participation in law of the sea development from the 1958 First U.N. Conference on the Law of the Sea to the present. The book provides the background essential to an understanding of Vietnam's current maritime relations and of the challenge to incorporate Vietnam into a stable regional order. Law of the sea specialists, Southeast Asia area specialists, and those interested in the development of Vietnam's hydrocarbon and fishery resources will find this a particularly valuable resource.

This book was released on 2023-09-20 with total page 917 pages. Available in PDF, EPUB and Kindle. Book excerpt: The fact that the Montego Bay Convention has been only ratified by 37 States at present and that it will be some time before the 60 ratifications required by Article 308 are achieved has not prevented states from acting in accordance with the rules drawn up by the Conference. Close on one hundred states have established either exclusive economic zones broadly modelled on Part V or 200-nautical-mile fishery zones and drawn on the principles laid down for exploiting living resources. Although these laws have been formulated unilaterally by states, international custom, since the judgement by the International Court of Justice in the Fisheries Case of 18 December 1951, is derived from concordant national rules. This shift began even before the Conference ended, and has been consolidated since then. Moreover, the régime governing the sea-bed beyond the limits of national jurisdiction defined by Part XI, which was the stumbling block of the Conference, is subject to transitional arrangements on the basis of two resolutions adopted in the Conference's Final Act, one providing for the establishment of a Preparatory Commission and the other on the preliminary activities of pioneer investors. This two-volume work, an earlier edition of which appeared in French, has been written by a team of experts of international renown. It presents an analysis of the Convention with an additional Chapter on the legal régime governing underwater archaeological and historical objects.

Book Synopsis Greece and the Law of the Sea by : Theodore C. Kariotis
Download or read book Greece and the Law of the Sea written by Theodore C. Kariotis and published by Martinus Nijhoff Publishers. This book was released on 1997 with total page 370 pages. Available in PDF, EPUB and Kindle. Book excerpt: Greece was one of the initial 119 delegations to sign the United Nations Convention on the Law of the Sea at the final meeting of the Conference for that purpose in December of 1982. When the Convention came into force in November 1994, only two countries opposed it. Turkey was one of them. Turkey has no plans to ratify the Convention in the near future. Greece & the Law of the Sea reviews the main developments in the Greek-Turkish dispute relating to the Greek islands in the Aegean Sea & analyzes all other aspects of the Greek maritime interests in the light of the Convention. The contributors have closely followed the creation of the new international law of the sea & discuss in their papers how this affects a great maritime nation, such as Greece, in a variety of ways. The work is published under the auspices of the recently established Aegean Institute of the Law of the Sea & Maritime Law, an independent scientific research center affiliated with the University of the Aegean, located in Rhodes. It constitutes one of the few books to cover Greek affairs in the English language. As such, it will greatly assist non-Greek speaking scholars interested in following & studying Greek affairs.

Book Synopsis The Exclusive Economic Zone by : Charles Quince
Download or read book The Exclusive Economic Zone written by Charles Quince and published by Vernon Press. This book was released on 2019-02-15 with total page 301 pages. Available in PDF, EPUB and Kindle. Book excerpt: Traditionally, the law of the sea was divided into the territorial sea and the high seas which accounted for the application of different rules under different circumstances. Concerning the territorial sea, the coastal state enjoys full sovereignty to the right of innocent passage, while under the high seas rules all countries enjoy multifaceted uses of the sea qualified only by the limitations imposed by international law. The development of the exclusive economic zone ended this traditional dualism and ushered in guidelines that are embodied within the text of the LOS Convention. The Exclusive Economic Zone presents to academia and the general reading public a comprehensive study of the EEZ concept as it relates to the LOS Convention and state practice. The Exclusive Economic Zone shows that even through coastal states have the right to develop a 200 miles EEZ and that this right is an integral part of contemporary international relations, it is also true that the EEZ concept is shrouded in legal ambiguities. Using qualitative and inductive methods, the scholarship draws on treaties, official proclamations, government archives, and scholarly works that are germane to the development of the EEZ. Students, scholars, and members of the general public with an interest in international law will find that The Exclusive Economic Zone deepens their understanding of the evolution of the EEZ concept.

Book Synopsis The Maritime Boundaries of the Indian Ocean Region by : Vivian Louis Forbes
Download or read book The Maritime Boundaries of the Indian Ocean Region written by Vivian Louis Forbes and published by NUS Press. This book was released on 1995 with total page 292 pages. Available in PDF, EPUB and Kindle. Book excerpt: Adopting an integrated, multidisciplinary approach to the political geography of the Indian Ocean, this study analyses the Law of the Sea, evaluates the national legislation of those Indian Ocean littoral states which have proclaimed their maritime limits over offshore waters, examines the numerous bilateral and trilateral agreements on continental shelf and seabed limits of the states in the region. It also previews the potential demarcations in the region of study. Apart from its well written text, perhaps the most important aspect of the work is the exceptional series of beautifully drawn maps and diagrams accompanied by detailed captions or commentaries, a unique collection worthy of publication on its own.
