Available in PDF, EPUB and Kindle. Book excerpt: Eileen Spring presents a fresh interpretation of the history of inheritance among the English gentry and aristocracy. In a work that recasts both the history of real property law and the history of the family, she finds that one of the principal and determinative features of upper-class real property inheritance was the exclusion of females. This exclusion was accomplished by a series of legal devices designed to nullify the common-law rules of inheritance under which--had they prevailed--40 percent of English land would have been inherited or held by women. Current ideas of family development portray female inheritance as increasing in the seventeenth and eighteenth centuries, but Spring argues that this is a misperception, resulting from an incomplete consideration of the common-law rules. Female rights actually declined, reaching their nadir in the eighteenth century. Spring shows that there was a centuries-long conflict between male and female heirs, a conflict that has not been adequately recognized until now.

Available in PDF, EPUB and Kindle. Book excerpt: Biblical property law was concerned less with the efficient use and transfer of commercial assets than with protecting the rights of the family to the sources of their economic survival. This important collection of essays explores the legal link between property and family in the Bible, whether through the general law of inheritance or through special institutions such as redemption, the levirate and the sabbatical and jubilee years. It brings together the author's existing contributions, previously published in disparate law journals, to which have been added several unpublished studies and a general introduction.

Available in PDF, EPUB and Kindle. Book excerpt: From Kennebunkport to Kauai, from the Rio Grande to the Northern Rockies, ours is a vast republic. While we may be united under one Constitution, separate and distinct states remain, each with its own constitution and culture. Geographic idiosyncrasies add more than just local character. Regional understandings of law and justice have shaped and reshaped our nation throughout history. America’s Constitution, our founding and unifying document, looks slightly different in California than it does in Kansas. In The Law of the Land, renowned legal scholar Akhil Reed Amar illustrates how geography, federalism, and regionalism have influenced some of the biggest questions in American constitutional law. Writing about Illinois, “the land of Lincoln,” Amar shows how our sixteenth president’s ideas about secession were influenced by his Midwestern upbringing and outlook. All of today’s Supreme Court justices, Amar notes, learned their law in the Northeast, and New Yorkers of various sorts dominate the judiciary as never before. The curious Bush v. Gore decision, Amar insists, must be assessed with careful attention to Florida law and the Florida Constitution. The second amendment appears in a particularly interesting light, he argues, when viewed from the perspective of Rocky Mountain cowboys and cowgirls. Propelled by Amar’s distinctively smart, lucid, and engaging prose, these essays allow general readers to see the historical roots of, and contemporary solutions to, many important constitutional questions. The Law of the Land illuminates our nation’s history and politics, and shows how America’s various local parts fit together to form a grand federal framework.

Available in PDF, EPUB and Kindle. Book excerpt: Experts estimate that eighty percent of household wealth is inherited, and the average American who died in 2015 left approximately $177,000 to his or her family. Harry L. Munsinger, a lawyer practicing in Texas, explores the history of inheritance law in this fascinating book. Topics include: • English laws of succession, which evolved to favor wealthy families by passing real estate and family titles to the eldest surviving son. In contrast, the American colonies developed a democratic system of inheritance where land was divided equally among all the sons. • Goals of early inheritance laws, which were to keep ancestral lands in the family and to determine who would take the land when a father died. • Ways American laws of succession followed English common law during the colonial period and then developed variations more suited to America’s social and economic needs after the colonies won their independence from Britain. The author also highlights how any interested party can allege a defect in the execution of a will, how trusts were developed by courts of equity to avoid the rigid rules of English common law governing legal title and use of real property, and how families can safely and effectively transfer wealth.

Book excerpt: Academically rigorous yet welcoming and fully attuned to the needs of the student reader, Chris Bevan's Land Law represents a new breed of textbook, blending traditional and contemporary teaching approaches to guide readers to a confident understanding of the subject. With its lively, engaging writing style - in which the author's enthusiasm is always apparent - and distinctive way of speaking directly to students, anticipating their questions and areas of confusion, Bevan's book does not simply set out the law but actively teaches it. Clear explanations are complemented by carefully-crafted visual aids, conveying key concepts in ways that all students can understand, and topics are broken down into sections that are easy to digest. This book maintains a critical emphasis and encourages students to consider and understand the law in context (both within society and their degree). 'Key case' boxes offer concise insights on leading cases that pique students' interest, spurring them to conduct their own reading of primary material, and although the book reflects on historical background in order to make sense of today's law, its overriding perspective is forward-looking, epitomized in the 'Future directions' conclusions for each chapter which consider future implications and likely reforms. Balancing brevity with detail and rigour with accessibility, Land Law is a truly modern textbook that supports and motivates its readers, allowing them to reap the rewards an understanding of this complex but fascinating subject will bring.
