Book Synopsis Intersections of the Legal System and the Deaf Community by : David M. Feldman
Download or read book Intersections of the Legal System and the Deaf Community written by David M. Feldman and published by Springer Nature. This book was released on 2023-05-15 with total page 60 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines how those with disabilities, and in particular, the Deaf and hard-of-hearing, are impacted by the influence language and culture in policing, criminal law, and corrections. Frequently left out of policy making and research, almost no resources exist that can inform and aid law enforcement, legal, and correctional officials on culturally competent interactions with the Deaf and hard-of-hearing. As a result, this group is at a distinct disadvantage when dealing with law enforcement or the courts as well as being vastly underserved, which often lead to negative outcomes for the Deaf suspect/defendant/inmate as they attempt to interact with law enforcement and navigate the legal system. In a step-by-step presentation from arrest to incarceration each chapter will discuss a specific part of the legal system. As well as providing information on the topic, this book can serve as an important resource to the myriad of issues and difficulties that may be experiences by the Deaf suspect, defendant, or inmate, as well as by law enforcement officers, attorneys, and correctional officers. To illustrate these issues, previous cases of Deaf suspects, defendants, and inmates will be presented and discussed to clarify key issues and to provide a perspective of the problem. Each chapter dealing with these issues will also provide suggestions for more culturally competent interactions between the Deaf community and the legal system.

Book excerpt: Judicial proceedings conducted in English must be interpreted for people who do not understand the language or who are deaf or deaf-mute to protect their rights. Court officials generally believe defendants' rights are protected adequately under existing laws and in judicial proceedings, although steps taken by the courts to meet the needs of these people vary considerably. Enough data were not available to determine whether there is a serious problem with interpretive services. Efforts may be needed to develop a certification program or other procedure requiring that interpreters, especially in trials involving serious criminal offenses, demonstrate a minimum level of competence and to develop uniform criteria for determining when an interpreter should be provided. Currently, 49 states have statutory provisions pertaining to court interpreters. The scope of these statutes varies widely from state to state. Some state statutes apparently limit court interpreters to translating the testimony of witnesses, indicating that an interpreter's primary function is to serve the court. Few courts visited maintained records or other data showing the number of requests for interpreters or the number of times interpreters were used. Most court officials interviewed believed that defendants needing interpreter services were provided them. Courts visited had no uniform criteria or guidelines for determining when an interpreter should be provided.

Frequently challenging, they require special training and skills. This interaction process is further complicated when the suspect or witness does not speak the same language as the interviewer. A professional reference that can be used in police training or in any venue where an interpreter is used, Police Investigative Interviews and Interpreting: Context, Challenges, and Strategies provides solutions for the range of interview demands found in today’s multilingual environments. Topics include: What interpreting is, the skills required, and the role of interpreters in any job context Investigative interviewing in law enforcement Concerns about interpreter intervention and its impact on interview outcomes The value of word-based over meaning-based interpretation in police and legal contexts Nonlinguistic factors that can have an impact on the interpreting process The book explores the multi-faceted dynamics of conducting investigative interviews via interpreters and examines current investigative interviewing paradigms. It offers strategies to help interpreters and law enforcement officers and provides examples of interpreted interview excerpts to enable understanding. Although the subject matter and the examples in this book are largely limited to police interview settings, the underlying rationale applies to other professional areas that rely on interviews to collect information, including customs procedures, employer-employee interviews, and insurance claim investigations. This book is part of the CRC Press Advances in Police Theory and Practice Series.

Book Synopsis Working with the Deaf Community by : Grace Lohr Knox
Download or read book Working with the Deaf Community written by Grace Lohr Knox and published by . This book was released on 2023 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Research shows there is a separation between the hearing community and the Deaf community in terms of communication. While there is little research specific to interactions between law enforcement and the Deaf community, it is probable a communication barrier exists between law enforcement officers and the Deaf community as well, due to law enforcement officers not being properly trained to interact with this community of individuals. This study examines law enforcement officers’ perspectives of working with the Deaf community. Using qualitative data collected through interviews, law enforcement officers in central Texas provided insight based upon their experiences with members of the Deaf community. From these interviews it was found that law enforcement officers are not receiving efficient training to prepare them for interactions with individuals with communications barriers, like Deaf individuals. The findings of this exploratory qualitative study revealed support for continued research examining the experiences of law enforcement officers with the Deaf community as well as the possible need for further training for law enforcement in this area.
