Book excerpt: Distinguished by the critical value it assigns to law in Puritan society, this study describes precisely how the Massachusetts legal system differed from England's and how equity and an adapted common law became so useful to ordinary individuals. The author discovers that law gradually replaced religion and communalism as the source of social stability, and he gives a new interpretation to the witchcraft prosecutions of 1692. Available in PDF, EPUB and Kindle. Book excerpt: Of "Good Laws" and "Good Men" reveals how a Quaker minority in the Delaware Valley used the law to its own advantage yet maintained the legitimacy of its rule. William Offutt, Jr., places legal processes at the center of this region's social history. The new societies established there in the late 1600s did not rely on religious conformity, culture, or a simple majority to develop successfully, Offutt maintains. Rather, they succeeded because of the implementation of reforms that gave the expanding population faith in the legitimacy of legal processes introduced by a Quaker elite. Offutt's painstaking investigation of the records of more than 2,000 civil and 1,100 criminal cases in four county courts over a thirty-year period shows that Quakers - the "Good Men" - were disproportionately represented as justices, officers, and jurors in this system of "Good Laws" they had established, and that they fared better than did the rest of the population in dealing with it.

Available in PDF, EPUB and Kindle. Book excerpt: The ABCs of Crime and Punishment in Puritan New England explains the legal system impacted the Puritan society of the Massachusetts Bay Colony. The men who wrote and enforced these laws believed that every aspect of their lives should be aligned with the teachings of the Holy Bible. Adultery, common punishments, witchcraft, spectral evidence, etc. are explained in historical context. We might think of Puritan laws and practices as harsh, but they were perhaps more "civilized" compared to the general population back in the Motherland. Puritans chose to resolve their disagreements in a court of law rather than with raucous and revengeful behavior in the streets. This book describes the more negative aspects of life in early colonial New England. The first colonizers were very moral and upright citizens holding the Godly goal of establishing "A City on a Hill." Even from the beginning, there were those who did not hold these beliefs and standards and never had. The majority of those who migrated were indentured servants and suffered under the harsh realities of life in the New World. Despite their different views, they were forced to live under the demanding expectations and laws of the Puritan church.

Available in PDF, EPUB and Kindle. Book excerpt: The Trial of Anne Hutchinson re-creates one of the most tumultuous and significant episodes in early American history: the struggle between the followers and allies of John Winthrop, governor of the Massachusetts Bay Colony, and those of Anne Hutchinson, a strong-willed and brilliant religious dissenter. The controversy pushed Massachusetts to the brink of collapse and spurred a significant exodus. The Puritans who founded Massachusetts were poised between the Middle Ages and the modern world, and in many ways, they helped to bring the modern world into being. The Trial of Anne Hutchinson plunges participants into a religious world that will be unfamiliar to many of them. Yet the Puritans' passionate struggles over how far they could tolerate a diversity of religious opinions in a colony committed to religious unity were part of a larger historical process that led to religious freedom and the modern concept of separation of church and state. Their vehement commitment to their liberties and fears about the many threats these faced were passed down to the American Revolution and beyond.

Available in PDF, EPUB and Kindle. Book excerpt: Americanization of the Common Law remains one of the standard works on the transformation of law in America from the late colonial period to the end of the early republic. In a straightforward manner, William E. Nelson analyzes the profound ideological movement that grew out of the American Revolution and caused substantial structural change in the legal and social order of Massachusetts and, by extension, in the nation at large. The Revolution, Nelson argues, transformed a hierarchical and communitarian legal and social order into an egalitarian and individualistic one. For this edition, Nelson has written a new preface in which he discusses the book's initial reception and the relevant historiographical issues that have arisen since it was first published in 1975.

Book excerpt: The Puritans, who settled in America in the early 1600s, believed that if they followed God's laws as individuals and as a society, God would prosper them. America would become "the new Israel," God's light for the rest of the world. The Rev. Dr. George Gatgounis wrote The Puritan View of Substantive Biblical Law both as a constitutional attorney and a biblical scholar. He did much of the research at Harvard, which was founded by the Puritans to train their clergy. Despite its outward appearance of harshness--such as the dozen transgressions that merited the death penalty in the Massachusetts Bay Colony--Puritan society was founded on the consent of the citizens. At the center was individual spirituality. That spirituality was to be maintained by a strict observance of the Sabbath, which centered around biblical preaching. Certainly there is no going back to a Puritan society in this postmodern era. But perhaps there is something to be learned to guide our way forward.

Book excerpt: The new third edition of Law and Society provides a balanced, multidisciplinary, and comprehensive overview of law as an essential social institution that both shapes and is shaped by society. Between this book’s covers, readers will find the theoretical and conceptual contributions of anthropologists, historians, law professors, political scientists, philosophers, psychologists, and sociologists. By synthesizing this wide range of perspectives, the book provides readers with a nuanced and in-depth context to think about, discuss, and analyze current trends, issues, and events. Through this book, readers will also grasp the many ways law affects the lives of individuals and, more generally, how law and society affect each other in matters such as dispute settlement, criminal law, social movements, inequality, and social control. The third edition is brought up to date with the helpful reorganization of chapters. Separate chapters exploring how we define law, the differences among the major families of law, and dispute processing make the textbook more readable and adaptable to specific course objectives. Thorough revisions across the chapters reflect the latest sociolegal perspectives and research and include many new references and contemporary examples to help students appreciate a wide range of law and society issues. This thoughtful and stimulating introduction to the field is ideal for advanced undergraduate courses in Law and Society and Introduction to Law.
