Available in PDF, EPUB and Kindle. Book excerpt: Examining local content law and policy in the oil and gas industry, this book uses Nigeria as a primary case study, comparing its approach to countries such as Brazil and Norway which have also adopted local content laws in relation to their gas and oil industries. In considering various aspects of local content law and policy as they apply to the oil and gas industry, the book examines the factors behind the formulation of local content policies by petroleum producing states, and the various strategies they have employed to implement them. It analyses arguments against local content requirements from the perspective of international trade and investment law, and from liberal market economic theorists, who argue against its overall usefulness. The book highlights salient aspects of the oil and gas industry such as regulation, national oil companies, treatment of minorities, and policy formulation and implementation.

The book is arranged in such a chronological order, like reference books and dictionaries tend to be,that a lay person in going through it would now know how oil is explored and found, how oil fields may be onshore and offshore, how oil blocs are bidded for, how oil is drilled, including associated gas deposits, among others. The transportation of oil and gas, storage of oil and gas, refining of oil and processing of gas, marketing of oil and gas,the impact of oil and gas exploration, production and revenues on the Nigerian environment, politics and economy and a myriad of other issues are comprehensively covered. The book should prove most useful to the lawyer, petroleum geologist, petroleum engineer, policy makers, investors, local and international development agencies and bodies, lecturers and students specialising in wide ranging subjects as economics, development studies, engineering, management, public administration, insurance, marketing, accounting and finance.

Available in PDF, EPUB and Kindle. Book excerpt: Identifies and explains the essential elements of legislative frameworks that have attracted foreign direct investment into the petroleum sector and hence fostered development of petroleum resources in host states. The main purpose of a legislative framework for petroleum development is to provide the basic context for, and the rules governing, petroleum operations in the host country; to regulate them, as they are carried out by domestic, foreign, and international enterprises; and to define the principal administrative, economic, and fiscal guidelines for investment activity in the sector.Experience shows that the cornerstone of effective petroleum legislative frameworks for exploration and production operations is a broad, generic, short but thorough petroleum law (not overdetailed), complemented by enabling regulations and one or several variants of a model contract. Such frameworks give both the host country and international oil company investors a clear legal and contractual context in which to negotiate mutually advantageous exploration and production arrangements that develop the host state's petroleum resources. The fiscal and tax aspects of the framework may be detailed in the petroleum law or in a separate petroleum revenue code, either of which would complete the legislative package. Onorato identifies and details the essential elements of such a framework - petroleum law, regulations, and model contracts - and explains how these three components relate to one another. This paper - a product of the Legal Department - is part of a larger effort to disseminate the Bank's experience in successful legal reform in the sectors in which it has been involved.

Available in PDF, EPUB and Kindle. Book excerpt: Research Paper (postgraduate) from the year 2014 in the subject Energy Sciences, grade: 90%, University College London (School of Energy and Natural Resources Management), course: Law and Policy of Energy and Natural Resources, language: English, abstract: This paper discusses the internationalization of the petroleum industry as witnessed within Uganda’s petroleum legal and regulatory framework, drawing heavily on the Host Government Contracts (HGC). The country is selected for a number of reasons. First, the framework relates strongly with the other countries across East Africa, a region that is profoundly becoming a new petroleum frontier.1 Second, Uganda’s commercial oil discoveries realized in early 2006 have since increased to become the largest on-shore oil reserves in the Sub-Sahara Africa (SSA) over the last 20 years.2 Third, this ‘black gold’ potential has seen strong foreign interest, especially over the last ten years with country now pitted to become a top-50 oil producer in the mid-term if the development plan is achieved.3 As a result, the country has witnessed legal, regulatory and policy reforms; strongly over the last ten years, aimed at improved management of the nascent industry as shall be discussed. The paper is structured as follows. In the first section, a chronological development of country’s petroleum legal, regulatory and policy framework is discussed. Section two explains the HGC that has been employed in Uganda to manage its hydrocarbon resources. In the third section, internationalization of the industry as reflected in Uganda’s framework is considered. Although the focus is on host government contracting, the interdependence with the public law framework that governs it is appreciated. For this reason, the discussion permeates beyond the HGCs to include this framework. While it is adduced that internationalization within Uganda’s legal system is apparent and still progressing, the paper suggests that developing countries face some specific challenges. In the last section, these challenges are assessed along with recommendations to remediate them, and entrench this narrative.
