Le rapprochement se manifeste par la transformation de certains principes généraux et régimes spéciaux de responsabilité civile. En effet, les textes du Code civil relatifs à la responsabilité civile se sont révélés insuffisants et le droit positif pourrait intégrer des données caractéristiques du droit américain. Le rapprochement entre les droits français et américain peut être constaté dans certaines lois récentes et dans la jurisprudence française en raison de la transposition de plusieurs textes de droit communautaire inspirés de la Common law et du droit américain. Ainsi, le législateur français a entériné la réception des règles de droit américain dans l’organisation des régimes spéciaux de responsabilité telles que le droit des produits défectueux, le droit de l’environnement ainsi que dans la refonte de certains principes de la responsabilité civile des dirigeants de société. L’introduction des règles du droit américain qui s’opérait déjà dans certaines branches du droit français se prolonge dans le cadre des projets de recodification du droit français des obligations. Le droit prospectif enrichi de deux importants projets de réforme relatifs au droit des obligations est également empreint d’une mouvance anglo américaine. L’avant-projet de réforme du droit des obligations et de la prescription et le projet de réforme du droit des contrats ont été, à des degrés divers, un écho favorable à une partie de la doctrine française qui propose le recours aux pratiques juridiques américaines dans le cadre d’une réforme de la responsabilité civile. D’autres propositions de la doctrine inspirées du droit américain et qui concernent la nécessité d’ouvrir l’accès à la justice à des groupes de personnes pourraient également être entérinées par le législateur. Néanmoins, pour le moment, plusieurs pans entiers du droit français n’ont pas été affectés par le phénomène de l’américanisation. Toutefois, ce constat ne permet pas d’occulter le risque réel d’une acculturation de la pensée juridique française qui doit être pris en compte dans l’accueil éventuel des règles américaines et surtout dans l’application de la nouvelle hiérarchie des normes caractérisée par la primauté du droit communautaire fortement américanisé.

According to many commentators, this success is due, among others, to the fact that the Convention does not directly impact on the domestic law of the various legal systems, as it applies only to international - as opposed to purely domestic - contracts. The Convention, in other words, does not impose changes in the domestic law, which makes it easier for States to adopt the Convention. The results of this work were sent to the European Commission and have already been published in French. The English translation is now being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law.
