Bien qu'à ce jour la m-santé ne dispose toujours pas de cadre juridique strict, de plus en plus d'objets connectés de santé - cardiofréquencemètres, balances, piluliers, glucomètres, stylos à insuline, autotests INR, stents, inhalateurs... - arrivent sur le marché. Pour les utilisateurs, il est difficile de différencier les objets destinés au bien être, à la santé et ceux possédant le statut de dispositif médical. Les fabricants et les professionnels de santé ont donc un rôle à jouer auprès des patients dans le choix et l'utilisation de ces objets. Enfin, ces objets connectés sont, pour beaucoup, mal sécurisés et présentent des risques de piratage. Par conséquent, l'Etat et les autorités de santé vont devoir légiférer et protéger aussi bien les individus eux-mêmes que leurs données de santé. Une refonte du financement du système de santé sera aussi nécessaire pour inclure les objets connectés dans la prévention, le maintien à domicile et le suivi à distance des malades chroniques.

En effet, l'observance thérapeutique nécessite un rapport très proche et une communication optimale entre ses acteurs principaux, qui sont les équipes soignantes et le patient. La technologie étudiée au cours de ce travail est plus globale que seuls les téléphones mobiles, il sera abordé les objets connectés en général comme vecteur de communication. Le but sera de voir si l'utilisation de cette technologie aura un impact, sur la communication, entre le soignant et le patient, qui elle-même influe positivement sur l'observance thérapeutique. Au travers de cette thèse, il a été mis en avant que l'aspect psychologique des deux individus en tant que tels est primordial, car il influe sur la réussite ou non du bon suivi du traitement. Par ailleurs, les objets connectés se sont révélés être d'excellents outils pour fournir les clefs du succès, sans être directement la réponse au problème énoncé aux vues des nouvelles inquiétudes révélées comme la gestion des données.

La santé connectée et les dispositifs médicaux connectés sont des marchés en pleine croissance et des nouveautés apparaissent chaque jour. Cette thèse traite de l'écosystème actuel des objets connectés de bien-être et des dispositifs médicaux connectés liés à leurs applications mobiles et comment ces derniers vont permettre de bouleverser les systèmes de santé et la prise en charge des patients notamment dans les pathologies chroniques comme le diabète ou l'hypertension. Les enjeux sont énormes : au niveau juridique : la législation et la réglementation ont du mal à suivre le rythme des évolutions technologiques et cela provoque des blocages et des doutes que ce soit chez les utilisateurs ou chez les régulateurs. Au niveau éthique : les utilisateurs ont peur pour le devenir des données très personnelles collectées par ces objets, et cela est un frein dans le développement des objets connectés de santé. Au niveau économique : les objets connectés vont permettre aux systèmes de santé de faire des économies notamment avec le suivi à distance des patients qui évite des coûts d'hospitalisations et va bouleverser le rôle du pharmacien ou du médecin. Au niveau sociétal : grâce à la santé mobile les pays en développement vont pouvoir avoir accès aux soins auxquels ils n'avaient auparavant pas accès. Les objets et dispositifs médicaux connectés redonnent le pouvoir aux patients en ce qui concerne leur santé. Ils prennent conscience de leur état physique et psychique grâce aux capteurs qui mesurent certains de leurs paramètres vitaux en temps réel. Ces mesures, analysées par une application, une intelligence artificielle ou un professionnel de santé vont permettre à la médecine actuelle, où le patient était dans une relation de soumission face à son médecin, de se transformer en une nouvelle médecine : prédictive, personnalisée, préventive et participative. Cet empowerment du patient sur sa santé est particulièrement efficace dans la prise en charge des maladies chroniques : le malade connaît mieux sa maladie et ses symptômes et sait mieux se gérer ce qui améliore significativement l'observance des traitements médicamenteux et hygiéno-diététiques. Grâce aux objets connectés le patient devient le manager de sa propre santé et les professionnels de santé sont plus efficaces dans la gestion du traitement et du suivi de la prise en charge grâce au gain de temps induit. De plus, le médecin va pouvoir ainsi proposer un traitement personnalisé au patient en fonction de l'état du patient mesuré en temps réel. En résumé, la productivité des professionnels de santé est améliorée. Une fois que les barrières à l'implémentation des objets connectés en santé seront levées (l'absence de cadre juridique, la peur de la fuite des données personnelles, la fragmentation du marché des objets connectés et des applications de santé et le manque de connaissance des professionnels de santé envers ces objets), le marché deviendra mature et pourra révolutionner pleinement la santé de patients.
