Book excerpt: This is the first systematic study of language conflict in a developing society and of its consequences for the integrational processes of nation building. Jyotirindra Das Gupta maintains that language rivalry does not necessarily impede national integration, but can actually contribute to the development of a national community. He explains that the existence of a multiplicity of language groups in a segmented society is not, in itself, indicative of the prospects for successful integration. Only when language groups mobilize into political interest groups is it possible to determine the pattern of intergroup conflict likely to emerge. The way in which this conflict is handled and resolved depends upon the general political atmosphere and upon the type of institutions available for decision making. In the specific case of India, the author finds that because the Indian government has proved capable of meeting the demands of diverse language interests, it is supported by the Indian population as a whole for its role in mediating language rivalries. This book therefore offers evidence for the efficacy of democratic procedures for political development and integration. In the course of his analysis, Das Gupta discusses the impact of Indian language associations on national politics and on the political community in general; the formulation and implementation of a national language policy; and the language policies of nationalist and of separatist groups both before and since Independence. In order to place the Indian experience in a wider context he provides comparative empirical data from other countries. Book excerpt: The indigenous and Afro-descendant peoples along Nicaragua's Caribbean Coast, once colonized by the British, have long sought to establish their autonomy vis-à-vis the dominant Spanish-influenced regions of the Pacific coast. The book provides a wide overview of the autonomy process by looking at the historical background of autonomy, claims to land and language rights, and land demarcation and communal forestry projects. This book seeks to satisfy the globally emerging interest in the idea of autonomy and bi-zonality as an effective mechanism of conflict resolution and protection of minority rights. The post-Cold War era has witnessed a resurgence of conflictive ethnic and secessionist politics that has placed the taken-for-granted primacy of unitary, sovereign nation-states into question. Along with cases such as Cyprus, Northern Ireland, and the Basque regions of Spain, Nicaragua sought to resolve prolonged and protracted ethnic conflict, issues of minority rights to self-determination, and questions concerning the sovereignty of national states, through an autonomy process that extended beyond a narrow political settlement to include the exercise of cultural rights and control of local resources. Autonomy on Nicaragua's Caribbean Coast remains highly contested, being simultaneously characterized by progress, setbacks and violent confrontation within a number of fields and involving a multiplicity of actors; local, national and global. This experience offers critical lessons for efforts around the world that seek to resolve long-established and deep-seated ethnic conflict by attempting to reconcile the need for development, usually fostered by national governments, with the protection of minority rights advocated by marginalized minorities living within nation states.

Specifically, how can it attain both legal integration and language diversity simultaneously, without the latter compromising the former? C.J.W. Baaij argues that the answer lies in the domain of translation. A uniform interpretation and application of EU law begins with the ways in which translators and jurist-linguists of the EU legislative bodies translate the original legislative draft texts into the various language versions. In the European Union, law and language are inherently connected. The EU pursues legal integration, i.e. the incremental harmonization and unification of its Member States' laws, for the purpose of reducing national regulatory differences between Member States. However, in its commitment to the diversity of European languages, its legislative institutions enact legislative instruments in 24 languages. Language Diversity and Legal Integration assesses these seemingly incompatible policy objectives and contemporary translation practices in the EU legislative procedure, and proposes an alternative, source-oriented approach that better serves EU policy objectives. Contrary to the orthodox view in academic literature and to the current policies of the EU, this book suggests that the English language version should serve as the original and only authentic legislative text. Translation into the other language versions should furthermore avoid prioritizing clarity and fluency over syntactic correspondence and employ neologisms for distinctly EU legal concepts. Ultimately, Baaij provides practical solutions to the conflict between the equality of all language versions, and the need for uniform interpretation and application of EU law.
