Book excerpt: The chapters of this book explore, from different disciplinary perspectives, the relationship between transitional justice, distributive justice, and economic efficiency in the settlement of internal armed conflicts. They specifically discuss the role of land reform as an instrument of these goals, and examine how the balance between different perspectives has been attempted (or not) in selected cases of internal armed conflicts, and how it should be attempted in principle. Although most chapters closely examine the Colombian case, some provide a comparative perspective that includes countries in Latin America, Africa, and Eastern Europe, while others examine some of the more general, theoretical issues involved.

Book excerpt: Originally published in 2004. The book examines the possibility of resolving past and continuing social injustices that are rooted in colonial or some such other similar experience of states from a variety of perspectives. First the issue is examined from an international law perspective, which evaluates the validity of counter claims to title to land in affected SADC states. Secondly the issue is examined from a human rights perspective, which privileges promotion for the respect of the inherent dignity of all persons. Thirdly, the issue is examined from victimology and psychology schools of thought in order to understand both the effect and impact on stakeholders of the operative dynamics in conflicts that arise from long standing social injustices that are connected to colonial or some such other similar historical experience of States. The book proposes humwefficiency as a model for resolution of this type of conflict. This model targets preservation of the inherent dignity of all stakeholders by combining international human rights morality with local intuition about land ownership and use. In this sense, the book takes human rights theory beyond politics and utopia, and applies it to foster new social engineering technologies for the resolution of social injustices and promotion of social justice. This is justified by the fact that the human rights culture has evolved in a considerably short period of time to become the dominant culture of the world.

Download or read book Social Movements, Law and the Politics of Land Reform written by George Meszaros and published by Routledge. This book was released on 2013-08-21 with total page 235 pages. Available in PDF, EPUB and Kindle. Book excerpt: Social Movements, Law and the Politics of Land Reform investigates how rural social movements are struggling for land reform against the background of ambitious but unfulfilled constitutional promises evident in much of the developing world. Taking Brazil as an example, it unpicks the complex reasons behind the remarkably consistent failures of its constitution and law enforcement mechanisms to deliver social justice. Using detailed empirical evidence and focusing upon the relationship between rural social struggles and the state, the book develops a threefold argument: first, the inescapable presence of power relations in all aspects of the production and reproduction of law; secondly their dominant impact on socio-legal outcomes; and finally the essential and positive role played by social movements in redressing those power imbalances and realising law’s progressive potentialities.

Book excerpt: Land reforms emerged as one of the most important development strategies in the post-World War period. Many colonies achieved their political freedom and the aspirations of major anti-colonial forces mainly peasantry compelled their national government to enact and implement land reforms. India was one among them. A number of studies have been conducted on land reforms addressing the issues of equity and distributive justice, implementation and impacts. This study is also one among them with a difference that this study has been conducted not only to understand the status of implementation and impacts in terms of productivity and distributive justice but also to explore the possibility and potential of this measures for promoting human development. Land reforms with various dimensions have been one of the major issues for the nation as a whole and remained sensitive subject among the states from pre-independence period. Uttar Pradesh is one of the states where the issues of land reforms could attract leaders of freedom movement most. There have been expectations that the political will of the poverty sensitive government in power could translate the expectations of the landless poor, particularly dalit and poor through effective implementation of land redistribution in order to empower dalit and poor in real sense. Present study is an attempt to comprehend the ground reality of land reforms and its contribution towards promotion of human development in Uttar Pradesh based on household data from the sample villages.

Download or read book Philosophical Perspectives on Land Reform in Southern Africa written by Erasmus Masitera and published by Springer Nature. This book was released on 2020-11-27 with total page 341 pages. Available in PDF, EPUB and Kindle. Book excerpt: This edited collection explores a variety of philosophical perspectives on land reform in Southern Africa. Presenting an innovative focus on the philosophical themes in land reform, the contributors reflect on traditional African conceptualisations of the land, as well as Western interpretations, introducing specifically Southern African approaches to a wide range of debates. Rooted in questions of colonization and decolonization, the chapters examine what reform ought to do for the people of Africa, providing contemporary reflections on the different racial and cultural facets of the land. Notably, ideas of reconciliation, compensation, justice, development, emancipation, Ubuntu, and empowerment are explored. Vigorous and interdisciplinary in their approach, the fifteen original chapters tackle a range of questions such as: What does land mean in Africa? What ethical considerations are relevant? Which mechanisms should be used in addressing injustice regarding land reform and redistribution? Providing a comprehensive engagement with philosophical and political issues of land reform in Southern Africa, this volume is an invaluable resource to scholars, not only in Africa, but wherever similar questions of land, dispossession, and justice arise.
Book Synopsis Can There be Growth with Equity by : Klaus W. Deininger
Download or read book Can There be Growth with Equity written by Klaus W. Deininger and published by World Bank Publications. This book was released on 2000 with total page 32 pages. Available in PDF, EPUB and Kindle. Book excerpt: South African experience with efforts to implement land reform thus far indicates that to realize the potential and help solve the problems rural areas face, the government's land reform program needs to get beneficiaries, non-governmental organizations, and the private sector more involved. Land reform should empower the poor, improve productivity, and create sustainable rural livelihoods, not just redistribute hectares of land.
