Book Synopsis Consumer ADR in Europe by : Christopher Hodges
Download or read book Consumer ADR in Europe written by Christopher Hodges and published by Bloomsbury Publishing. This book was released on 2012-05-10 with total page 516 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first systematic comparative study into how consumer ADR systems (usually ombudsmen and médiateurs) work, the differing national architectures within which they operate and how they can be improved. It describes ADR schemes in Belgium, France, Germany, Lithuania, the Netherlands, Poland, Slovenia, Spain, Sweden and the United Kingdom as well as emerging pan-EU dispute resolution schemes. Use of the techniques of mediation, conciliation and adjudication are noted. It also covers EU measures on consumer ADR, and 2011 proposals for legislation on ADR and ODR. Data on volumes, cost and duration of ADR schemes are compared, both between different systems and with courts. The authors' findings underpin EU and national developments, and outline options for future policy. Findings and proposals are included for the functions, scope, performance, essential requirements, architecture and operation of ADR systems. The relationships between ADR, courts and regulators are discussed, and need for reforms are noted. This is a ground-breaking work that will have a major impact on European legal systems. This title is included in Bloomsbury Professional's International Arbitration online service.
Book Synopsis Victim-Offender Mediation in Europe by : EUFORUMRJ
Download or read book Victim-Offender Mediation in Europe written by EUFORUMRJ and published by Leuven University Press. This book was released on 2000-06-21 with total page 384 pages. Available in PDF, EPUB and Kindle. Book excerpt: This publication is an initiative of the European Forum for Victim-Offender Mediation and Restorative Justice, and results from its first conference which was held in Leuven, Belgium, from 27-29 October 1999. The first six chapters consider victim-offender mediation and restorative justice from a more theoretical point of view. These analyses of theoretical, legal, policy, ethical and societal aspects of mediation and restorative justice have been written by well-known scholars in this field. The second part of the book consists of overviews of the situation with regard to victim-offender mediation in the eight European countries in which it is currently the most developed (Austria, Belgium, Finland, France, Germany, Norway, Poland and the United Kingdom). For these last chapters, a multitude of information was collected in each of these countries, and this is presented and analysed comparatively. The following topics are discussed for each of the countries: the history of victim-offender mediation in that particular country, the legal context, policy and implementation, the number of programmes and the way they function, the practice of mediation, the number and characteristics of cases, evaluation and research, and finally challenges, obstacles and expectations for the future. This is probably the first time that such extensive reports on the practice of victim-offender mediation in Europe have been brought together in this way. In publishing this book the European Forum is seeking to contribute to the realisation of one of its objectives, namely providing people all over Europe - and beyond - with information on victim-offender mediation and restorative justice in other countries. Restorative justice is a relatively new field and is still very much evolving. A full exchange of information and ideas will contribute to this process.

Available in PDF, EPUB and Kindle. Book excerpt: The book explores the relationship between fundamental rights and private law in Europe, a debate usually referred to as Drittwirkung or ‘horizontal effect of fundamental rights’. The work focuses on the field of tort law and looks, in particular, at the legal position of the tortfeasor. Part I of the book is dedicated to exploring the different possible models of Drittwirkung, the functions and evolution of tort law, and the particular impact that fundamental rights may have in shaping the legal consequences that may derive to tortfeasors from their tortious acts. Part II focuses on the relationship between children’s tortious liability and their fundamental rights in a number of jurisdictions including France, Italy, Germany, Portugal, Sweden, Finland, and England and Wales. The book goes on to consider policy implications and advances proposals which would ensure the optimisation and maximisation of the scope of fundamental rights in the field of tort law.
Book Synopsis Changes in Society, Crime and Criminal Justice in Europe by : C. J. C. F. Fijnaut

This book was released on 1995 with total page 394 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 1994 the School of Criminology, a part of the Department of Criminal Law, Criminal Procedure and Criminology in the Faculty of Law of the Katholieke Universiteit Leuven, celebrated the 25th anniversary of its study programme. To give added lustre to this landmark in its history, the Institute accepted the invitation from the International Society of Criminology to organise the 49th International Course of Criminology. The title of the course was: Changes in Society, Crime and Criminal Justice in Europe. A challenge for criminological education and research'. This course explored two themes, both of which are likely to be the focus of debate in criminal policy in the near future: crime and insecurity in the city, and international organised and corporate crime. The presentation and discussion of both themes followed two main approaches. Lectures and seminars focused on the analysis of the nature, the quantity and the development of the phenomena, and meetings were focused on the policy needed to gain control of these phenomena. Moreover, attention was paid to technical and ethical problems which show up at the moment that empirical research is carried out. This publication brings together the main part of the introductory lectures. Part one relates to the theme of crime and insecurity in the city; the second part contains the lectures on international organised and corporate crime. Together both parts present a good picture of what was explained and commented on during the Course, especially in relation to important European developments concerning crime, criminal justice and criminal policy. This book will become an important source of inspiration for both criminological educationand research.

This book was released on 2015-05-22 with total page 185 pages. Available in PDF, EPUB and Kindle.

Book Synopsis International Law of Victims by : Carlos Fernández de Casadevante Romani
Download or read book International Law of Victims written by Carlos Fernández de Casadevante Romani and published by Springer Science & Business Media. This book was released on 2012-07-11 with total page 279 pages. Available in PDF, EPUB and Kindle. Book excerpt: After having ignored victims, only recently both domestic and international law have begun to pay attention to them. As a consequence, different international norms related to victims have progressively been introduced. These are norms generally characterized by a certain concept from the perspective of victims, as well as by the enumeration of a list of rights to which they are entitle to; rights upon which the international statute of victims is built. In reverse, these catalogues of rights are the states’ obligations. Most of these rights are already existent in the international law of human rights. Consequently, they are not new but consolidated rights. Others are strictly linked to victims, concerning the following categories: victims of crime, victims of abuse of power, victims of gross violations of international human rights law, victims of serious violations of international humanitarian law, victims of enforced disappearance, victims of violations of international criminal law and victims of terrorism.
Book Synopsis Queer Migration and Asylum in Europe by : Richard C. M. Mole
Download or read book Queer Migration and Asylum in Europe written by Richard C. M. Mole and published by UCL Press. This book was released on 2021-03-08 with total page 276 pages. Available in PDF, EPUB and Kindle. Book excerpt: Europe is a popular destination for LGBTQ people seeking to escape discrimination and persecution. Yet, while European institutions have done much to promote the legal equality of sexual minorities and a number of states pride themselves on their acceptance of sexual diversity, the image of European tolerance and the reality faced by LGBTQ migrants and asylum seekers are often quite different. To engage with these conflicting discourses, Queer Migration and Asylum in Europe brings together scholars from politics, sociology, urban studies, anthropology and law to analyse how and why queer individuals migrate to or seek asylum in Europe, as well as the legal, social and political frameworks they are forced to navigate to feel at home or to regularise their status in the destination societies. The subjects covered include LGBTQ Latino migrants’ relationship with queer and diasporic spaces in London; diasporic consciousness of queer Polish, Russian and Brazilian migrants in Berlin; the role of the Council of Europe in shaping legal and policy frameworks relating to queer migration and asylum; the challenges facing bisexual asylum seekers; queer asylum and homonationalism in the Netherlands; and the role of space, faith and LGBTQ organisations in Germany, Italy, the UK and France in supporting queer asylum seekers.
