This paper explores the characteristics of this unemployment problem, its causes, and provides a brief discussion of recent labor market reform measures and their likely Impact. A demographic shift in recent years has produced a large rise in female labor force participation and a decrease in agricultural jobs to which the economy has been unable to adjust. The effects of generous unemployment benefits and the large underground economy may explain 6–12 percentage points of the resulting unemployment, but the remainder must be explained by failures and rigidities in the labor market. The paper presents econometric evidence that unemployment displays hysteresis, and that wages are not responsive to changes in the unemployment rate. This evidence supports the claim that insider-outsider factors and rigidities in the legal structure of the labor market are responsible for much of the high unemployment rate. Recent reforms have improved the functioning of the labor market, but they are unlikely to be sufficient to reduce unemployment to single digit rates without further action.

This perception, however, is at odds with international labour standards, under which self-employed persons should also be able to conclude collective agreements to some extent. It is now commonplace for companies to offer various forms of non-standard employment that shift risk from the labour engager to the labour provider – which may increase the likelihood of those workers to fall outside the legal concept of ‘employee’ and because of that affects their legal protection. Legal practitioners may then face a dilemma: what may be required under labour law may be prohibited under antitrust law. In the first comprehensive analysis of these intensely debated issues, the authors argue that there is an urgent need to address the current legal puzzle, including through regulatory measures. This must include, in particular, the existing regulation at the level of the European Union (EU), which dominates competition law in the Member States. The book combines an analysis of the supranational framework by experts in labour law as well as competition law with in-depth country reports from Member States of the EU in which regulations and/or practices of collective bargaining for the self-employed exist. Focusing on areas of potential conflict between these two broad objectives, Robert Fishman here traces the development of the complex political role and organizational development of the Spanish workers' movement in the transition from dictatorship to democracy. Drawing on rich empirical data including interviews with 324 plant-level labor leaders, Fishman examines the interplay between various unions' efforts to organize labor and to deal with national politics. He shows how the workers' movement, long an advocate of a ruptura or clear break with the Francoist past, came to support a process of negotiated reform and mobilizational restraint. Labor leaders' belief in the legitimacy of the democratic state, Fishman demonstrates, can serve as a key predictor of their willingness to support negotiated wage restraint. Book excerpt: Following the death of Franco, Spain underwent a transition to democracy in the mid-1970s. Although a rapid process of modernization occurred, the Spanish welfare state was seen, until fairly recently, as relatively underdeveloped. However, given the progressive Europeanization and expansion of Spanish social policy, questions arise as to whether the Spanish welfare system should still be considered as peripheral to West European welfare states. This volume is divided into three sections. The first section deals with broad trends in the evolution of the Spanish welfare state. To begin with, the consolidation path of social protection policies is explored. Attention is also paid to the process of Europeanization. Furthermore, the analysis explores advances in gender equality policies. In the second section, attention is turned to governance issues, such as collective bargaining, the interplay among levels of government, the welfare mix and public support for social policies. The third and final part of the book addresses five main challenges facing the Spanish welfare state in the 21st century, namely, the need to enhance flexicurity; to achieve a better work-family balance; to coordinate immigration policies with existing social protection; to tackle the persistence of high rates of relative poverty; and to face intense population ageing, both in terms of increasing needs for care and the reform of the pension system.
