En un balance general, sin embargo, los logros son evidentes. El desarrollo de las instituciones de la democracia, empezando por el Parlamento, ha encontrado en el desarrollo de la jurisprudencia constitucional un importante respaldo para mejorar su desempeño. En el caso del Congreso, en algunas de sus últimas decisiones, el Tribunal se ha referido a la calidad de la deliberación de las leyes, intensificando su estándar de control a la legislación incluso a nivel del procedimiento legislativo. Su jurisprudencia sobre el control del razonamiento del juez ordinario ha generado, por otro lado, un importante diálogo judicial que, sin lugar a duda, ha permitido mejorar los estándares de calidad de la tutela judicial efectiva. Otro tanto ha ocurrido con las sentencias sobre la administración pública. Desde la discrecionalidad administrativa, hasta la proporcionalidad de las sanciones de los órganos administrativos, el TC ha participado activamente controlando el poder de la administración frente a los ciudadanos. La necesidad de un balance sobre el impacto de la jurisprudencia del TC en nuestro sistema jurídico nos convocó en el mes de junio pasado a un grupo de profesores del área del Derecho Constitucional de distintas universidades, para discutir los diversos aportes y desafíos de la justicia constitucional en nuestro país. Aquí se recoge un conjunto de aquellas ponencias que dan testimonio de este importante evento.
