Book excerpt: La fraude paulienne est traditionnellement présentée comme une fraude au droit de gage général des créanciers. Or il peut être montré qu'elle a pour fondement le principe de la force obligatoire de tout droit de créance, ce à quoi correspond la localisation de l'article 1167 dans le code civil. Dès lors, la fraude paulienne ne s'applique pas seulement aux actes par lesquels le débiteur se rend insolvable, mais également aux actes par lesquels il compromet l'exécution en nature du droit spécial d'un créancier. La fraude paulienne s'identifiant à la cause de l'acte frauduleux, la sanction de son illicéité passe nécessairement par un anéantissement des effets de l'acte. Cette inefficacité de l'acte frauduleux peut prendre la forme d'une inopposabilité ou d'une nullité selon ce qui est utile au rétablissement du droit du créancier, et partant, au rétablissement de la légalité. La combinaison de ces deux sanctions peut être admise car seule une différence de degré et non de nature sépare l'inopposabilité de la nullité. Cette définition de la nature de la sanction de la fraude permet d'identifier les conditions d'exercice de l'action paulienne.
