Book excerpt: La question des fondements de la responsabilité a été l’une de celles qui a le plus intéressé la doctrine depuis l’abandon du principe de l’irresponsabilité des personnes publiques. Tantôt compris comme un principe général d’explication, tantôt comme une véritable règle juridique, le fondement de la responsabilité est un élément de justification. Afin de clarifier le discours visant à expliquer le mécanisme de responsabilité, le fondement juridique de la responsabilité doit être distingué des principes qui justifient l’existence de cette règle et des conditions parfois mises à l’application de celle-ci. Jurisprudence et doctrine ont fait du risque et du principe d’égalité devant les charges publiques les deux fondements de la responsabilité sans faute en droit administratif. Cette présentation classique est aujourd’hui dépassée du fait de la création par le Conseil d’Etat de régimes de responsabilité dans lesquels la faute n’est pas exigée et qui ne sont pas pour autant rattachables à ces fondements classiques. Il apparaît donc que la présentation classique de la responsabilité sans faute doit être abandonnée au bénéfice d’une présentation centrée sur la notion d’obligation. Les hypothèses de responsabilité dans lesquelles la condition de faute n’est pas exigée peuvent alors être classées en deux catégories. Celles dans lesquelles le fait générateur méconnaît une obligation préexistante sont constitutives de véritables régimes de responsabilité, et celles dans lesquelles le fait générateur ne méconnaît aucune obligation préexistante et qui ne sont alors qu’abusivement rattachées à la responsabilité. La responsabilité sans faute, qui n’est qu’une catégorie négative n’ayant aucune unité, n’a pas de fondements propres ce qui la distinguerait par nature d’autres hypothèses de responsabilité.

Vingt régimes très divers y sont actuellement classés. Leur analyse permet de comprendre l’évolution historique de la responsabilité sans fait. La création de la responsabilité sans fait produit trois types de conséquences qu’il faut étudier. D’abord, elle joue un rôle particulier dans l’indemnisation des victimes. Ensuite, elle exerce une influence sur les catégories actuelles de la responsabilité publique que sont la responsabilité pour faute et la responsabilité sans faute. Enfin, elle est le point de départ d’une recomposition de l’architecture de la responsabilité publique. En effet, cette matière peut être présentée grâce à la distinction responsabilité pour fait / responsabilité sans fait.

La responsabilité sans faute peine cependant à s'imposer comme une voie de droit effective à disposition des particuliers en raison, d'une part, des réticences du juge à la reconnaître expressément comme un principe de responsabilité extra-contractuelle et, d'autre part, de l'interprétation rigoureuse des conditions de son bien-fondé.

Seulement lorsqu’un coût social excessif ne peut être évité, l’état de nécessité intervient dans le cadre des obligations secondaires de la responsabilité internationale, en tant que circonstance atténuante. After much hesitation, the International Law Commission codified the state of necessity as a circumstance precluding wrongfulness in the field of State responsibility. This study aims to demonstrate that it is a much wider mechanism, essential to international law and strictly connected to its own characteristics. It performs the function of limiting the substantial obligations of States in case of the realization of a fact condition – a situation of necessity – in order to avert an excessive social cost, born out of law implementation. It always works through a balance of conflicting interests. Only when a social cost cannot be avoided, the state of necessity, under the features of a mitigating circumstance, enters the field of secondary obligations relating to international responsibility.
