Book excerpt: Le 14 juin 2002, l'Assemblée nationale du Québec sanctionne la Loi modifiant le Code des professions et d'autres dispositions législatives dans le domaine de la santé (Projet de loi 90). L'adoption de ce projet de loi est caractérisée par l'apport de modifications significatives au modèle de soins traditionnel, notamment par l'élargissement et la redéfinition du champ d'exercice de certains professionnels, par le partage d'activités réservées et par l'élaboration de conditions d'exercice associées aux activités déléguées. Une nouvelle classe d'infirmières - l'infirmière praticienne spécialisée - est désormais habilitée par règlements à exercer des activités réservées aux médecins. L'élargissement du champ d'exercice de ces infirmières soulève de fait la question de la responsabilité civile, un sujet complexe ayant des répercussions sur nombre d'acteurs : infirmières praticiennes spécialisées, médecins, établissements de santé, autres professionnels oeuvrant dans le domaine de la santé, de même que les patients. Puisque la pratique infirmière avancée n'en est encore qu'à ses balbutiements au Québec, et que tout ce qui concerne la responsabilité civile n'est pas clairement défini et établi, le texte qui suit propose d'explorer et d'analyser le cadre légal de ce rôle infirmier émergent ainsi que les règles régissant l'imputabilité de l'infirmière praticienne spécialisée, du médecin avec qui elle collabore et de l'établissement de santé qui l'emploie.
