Depuis quelques années, cette position traditionnelle est cependant l’objet de tensions croissantes, qui se manifestent dans deux sens a priori opposés. D’un côté, dans la mesure où se développe, depuis les années 1990, une règle de droit international imposant l’Etat de droit, la remise en cause du gouvernement constitutionnel par la force paraît avoir été progressivement interdite. D’un autre côté, cependant, le renversement par la violence de certaines autorités à la fois légales, mais aussi considérées comme autoritaires ou dictatoriales semble avoir été accepté et même favorisé par un grand nombre d’Etats et d’organisations internationales, en particulier l’ONU, notamment dans le contexte du « printemps arabe ». Ainsi pourrait-on envisager l’émergence d’une certaine forme de droit à la rébellion, même si c’est dans des limites qui restent à définir et à concilier avec les règles qui confèrent à l’Etat un droit, voire un devoir, de maintenir l'ordre. Spécialement dans ses évolutions récentes, le droit international paraît donc entretenir une relation ambivalente avec le phénomène de la rébellion.

Each main section is further subdivided with ever-increasing specificity into sub-sections on codification, codification attempts, general studies, studies of certain recognition questions and studies of specific recognition cases. The bibliography employs a broad meaning of recognition. It is not restricted to the question of status of an authority or entity in international law but encompasses also the question of relations with it. As many of the recognition cases must be considered, and can only be understood, against their historic, political and sometimes even economic background, the bibliography includes not only purely legal treaties but also publications of a primarily historical, political or economic content which incidentally deal with aspects of recognition in international law. This is reflected by the titles of the 730 journals from more than 50 countries in 20 different languages which have been used to compile the bibliography. Drawing on his extensive experience as a human rights practitioner and scholar, Dr. Hessbruegge sets out in careful detail the strict requirements that human rights impose on defensive force by law enforcement authorities, especially police killings in self-defense. The book also discusses the exceptional application of the right to personal self-defense in military-led operations, notably to contain violent civilians who do not directly participate in hostilities. Human rights also establish parameters on how broad or narrow the laws can be drawn on self-defense between private persons. Setting out the prevailing international standards, the book critically examines the ongoing trend to excessively broaden self-defense laws. It also refutes the claim that there is a human right to possess firearms for self-defense purposes. In extraordinary circumstances, the right to personal self-defence sharpens human rights and allows people to defend themselves against the state. Here the author establishes that international law gives individuals the right to forcibly resist human rights violations that pose a serious risk of significant and irreparable harm. At the same time, he calls into question prevailing state practice, which fails to recognize any collective right to organized armed resistance even when it constitutes the last resort to defend against genocide or other mass atrocities.
