L’Institut religieux a ainsi le droit et devoir de discerner cette vocation et s’assurer que ne soient admis et permis d’y rester que ceux qui possèdent les qualités requises pour vivre pleinement leur vocation, selon le charisme et la discipline de l’Institut. C’est dans ce système de protection des droits des parties impliquées, du religieux et de l’Institut, que le Canon 700 du Code actuel revêt toute son importance. En effet, par cette norme, le législateur garantit le respect des droits des religieux affectés par le renvoi de l’Institut et veille à ce que soit éliminée toute possibilité d’un renvoi arbitraire et illégitime. L’Institut jouit pareillement du droit de défendre sa décision de renvoyer un membre délinquant ou incorrigible, afin de protéger son identité charismatique et sa mission, et protéger ainsi la vocation des membres qui restent. La norme du Canon 700 prévoit donc un remède efficace contre les cas éventuels de renvoi arbitraire et illégitime, notamment, à travers le recours avec effet suspensif, d’abord hiérarchique, ensuite, juridictionnel contentieux administratif.
