Cette diversité est essentielle pour l'intégrité des écosystèmes marins qui, à leur tour, fournissent des services fondamentaux à l'humanité. Or, la diversité de la vie dans les océans est menacée par le comportement irresponsable de l'Homme entraînant la pollution du milieu marin, la destruction des habitats et la surexploitation des ressources marines vivantes. Vu la discordance entre les caractéristiques naturelles des océans (notamment l'homogénéité relative du milieu marin) et leur régime juridique fragmenté, une action au niveau international prenant en compte la complexité des écosystèmes marins est nécessaire pour faire face aux dangers encourus par la biodiversité marine. Une telle action est toutefois compliquée par le caractère disparate du droit international dans ce domaine. Évoluant de façon ad hoc en réaction aux problèmes particuliers identifiés par les scientifiques, le droit international perçoit les divers organismes marins soit comme des ressources naturelles, soit comme des composantes menacées de la nature, et les soumet ainsi à des règles et institutions différentes. Cette disparité n'empêche pas une action efficace au profit de la biodiversité marine à condition toutefois que les acteurs compétents respectent les principes généraux du droit de l'environnement. Ces derniers permettent en effet de surmonter le caractère disparate du droit international en créant un cadre général d'harmonisation au sein duquel le rôle de toutes les institutions existantes serait respecté et leurs efforts au profit de la biodiversité marine se renforceraient mutuellement.

La question environnementale devient alors une problématique universelle, objet de tous les débats, même si en ces temps, les pollutions demeuraient encore relativement localisées à certains éléments de la nature comme les cours d’eaux d’importance internationale. Il s’agit alors d’appréhender la question de la protection de l’environnement marin par le droit international. Résultant de la complexité des relations entre l’homme et la nature (qui constitue d’ailleurs son cadre de vie), il apparait nécessaire de réguler les rapports de celui-ci avec cette dernière pour sa survie existentielle mais aussi et surtout pour la préservation des droits (à la vie) des générations futures. La nécessité de préciser les contours de la notion d’environnement marin peut s’expliquer et se justifier par toute une série de notions voisines renvoyant de manière fort utile à la même réalité -de préservation de la vie présente et future par la pratique de l’équité intergénérationnelle- en partant de : écologie, nature, espace maritime, biodiversité, ressources halieutiques, minières... et aboutissant à la notion synthétique de développement durable. La notion d’environnement marin est donc toute aussi vaste que l’espace auquel il s’applique. L’environnement s’appréhende comme une notion polysémique. Du point de vue de la littérature, l’expression environnement signifie l’ensemble des éléments naturels et artificiels qui entourent un individu humain, animal ou végétal ou une espèce. Aussi apparait-elle comme la composition des éléments objectifs et subjectifs qui constituent le cadre de vie de l’individu. Vu sous cet angle, l’environnement demeure une notion superficielle dans la mesure où elle est présentée comme un phénomène matériel et statique dont l’existence semble à première vue éternelle. Elle serait non évolutive, non dégradable car cette définition littérale établie une relation de passivité de l’homme avec cette dernière. Or l’homme est un être insatiable et abusant de son voisin environnement. En tant qu’unique être doué de raison, il a toujours eu un ascendant sur la nature, selon une conception anthropocentriste.

UNCLOS has been described as the Constitution for the Oceans. It sets out the fundamental rights, obligations and jurisdictions of States regarding the access to, uses and management of the oceans and seas and their resources. It balances States’ diverse and sometimes conflicting interests, such as conflicting uses of space, against navigational interests and the protection of the marine environment. UNCLOS is the first global treaty to include comprehensive obligations on the protection and preservation of the marine environment, including the conservation of living marine resources. These are often common or cross-border challenges, which can only be addressed through international cooperation. The book is divided into three thematic parts. The first concerns the role of international organizations in ocean governance. It includes twelve chapters covering a very diverse set of issues, both materially and geographically, that demonstrate the importance of coordinated actions on the part of multiple States for obtaining harmonized solutions regarding the pursuit of activities in maritime spaces (in connection with e.g. navigation, fisheries or maritime security). The second part concerns the relevance of dispute settlement mechanisms for understanding the international law of the sea and the international legal framework within which the actions of the great maritime powers take place. It is composed of three chapters, examining stakeholders’ role in dispute settlement, the position taken by China and the Russian Federation regarding international litigation in maritime spaces, and how the South China Sea Award may be relevant to the debate on the international legal concepts of rock and island. As a result, IMO conducted a review process which led to substantially updated guidelines adopted in late 2005. This book provides a detailed analysis of the PSSA guidelines and protective measures available in PSSAs. Emphasis is placed on their legal basis and the implications for coastal states' jurisdiction over vessel-source pollution.
