Book excerpt: El ejercicio de los derechos fundamentales en el contrato de trabajo y su protección es un asunto de singular importancia que ha ocupado la atención de la doctrina española y particularmente de la jurisprudencia del Tribunal Constitucional desde sus inicios. El reconocimiento de la eficacia horizontal de los derechos fundamentales es el punto de partida en la elaboración de la amplia doctrina judicial sobre la protección y el alcance de estos derechos cuando son ejercidos en el ámbito del contrato de trabajo, cuestión que adquiere mayor relevancia en nuestros días cuando la aplicación de las nuevas tecnologías en la empresa se pueden traducir en una potencial violación de los derechos fundamentales del trabajador. Es por esto que en la doctrina iuslaboralista española se habla de los derechos laborales inespecíficos, para hacer referencia a aquellos derechos fundamentales que no tienen un contenido estrictamente laboral, pero que son ejercidos en el contrato de trabajo. El presente escrito hace un análisis de la jurisprudencia del Tribunal Constitucional, que ha fijado los criterios para el ejercicio de los derechos fundamentales en el contrato, contrayendo el estudio a aquellos derechos que con mayor facilidad pueden verse vulnerados en una relación de trabajo. También analiza los distintos mecanismos de protección previstos en la legislación positiva y las eventuales sanciones que se puedan derivar para el empresario infractor.
