This book was released on 2013-10-28 with total page 166 pages. Available in PDF, EPUB and Kindle. This book summarizes the state of discussions regarding net neutrality in Europe. It comes at the time the European Commission intends to legislate to guarantee the right of all citizens to access the open Internet. Net neutrality is not only about how to ensure the fundamental right to receive and impart online information. The rules on the protection of consumers, by fostering transparency, also contribute to Internet neutrality and openness. Similarly competition law prohibits anti-competitive discrimination, including in Internet communications. Net neutrality thus appears at the juncture of various areas of the law. The contributions of this book compare the merits of various forms of regulation and discuss the policy dimensions of the net neutrality debate.

Book excerpt: 'Intellectual property and private international law' was one of the subjects discussed at the 18th International Congress of Comparative Law held in Washington (July 2010). This volume contains the General Report and 20 National Reports covering Canada, US, Japan, Korea, India and a number of European countries (Austria, France, Germany, UK, Spain etc). The General Report was prepared on the basis of National Reports. The national reporters not only describe the existing legal framework, but also provide answers for up to 12 hypothetical cases concerning international jurisdiction, choice-of-law and recognition and enforcement of foreign judgments in multi-state IP disputes. Based on their answers the main differences between legal systems as well as the shortcomings of the cross-border enforcement of IP rights are outlined in the General Report. The Reports in this volume analyse relevant court decisions as well as recent legislative proposals (such as the ALI, CLIP, Transparency, Waseda and Korean Principles). This book is therefore a significant contribution to the existing debate in the field and will be a valuable source of reference in shaping future developments in the cross-border enforcement of IP rights in a global context.

The ancient Romans and Egyptians, on the other hand, were adept at virtuality, an intangible world that intersected with the tangible one, and it is to their laws that she turns for new frameworks and practices. Book excerpt: Conflicts of laws arising from injuries to rights of personality—such as defamation or invasion of privacy—have always been difficult, if only because they implicate conflicting societal values about the rights of freedom of speech and access to information, on the one hand, and protection of reputation and privacy, on the other hand. The ubiquity of the internet has dramatically increased the frequency and intensity of these conflicts. This book explores the ways in which various Western countries have addressed these conflicts, but also advances new, practical ideas about how these conflicts should be resolved. These ideas are part of an international model law unanimously adopted by a Resolution of the Institut de droit international, which addresses jurisdiction, choice of law, and recognition and enforcement of foreign judgments. The book provides extensive article-by-article commentary, which explains the philosophy and intended operation of the Resolution.

Book excerpt: This is the first book to emphasize the role of the judicial cooperation aspect of cross-border intellectual property litigation. Starting from European private law as it is currently evolving, the authors focus intensively on the issues surrounding such central questions as the following: How different should the treatment of IP litigation be from other transnational private activity? How different should the treatment of different IP forms be, at least from a private international law perspective? How do the answers to these questions relate to methodological shifts within the discipline of private international law itself? How should the doctrinal solutions we give integrate “substantive” values such as the EC basic freedoms or new ideas about the meaning of “property” in the context of intellectual works? What should the relationship be between the rules on jurisdiction and the rules on applicable law? How global or how distinct do we want the European legal regime in this area to be? What should be the coordination and/or allocation of competences between the various international institutions and instruments?

Book excerpt: This title explores the issue of innovation engineering, a feature that is essential to the continuation of growth and development in the commercial world. Discussion is divided into three parts: Part I covers the historical basis of innovation, noting that diversity rests upon a duality between concepts in theory and applications put into practice, as well as discussing how innovation has resulted from the interaction of numerous factors, be they societal, human, managerial, organization or technological. Part II focuses on practical applications – the technologies, tools and methods employed in putting theoretical innovation into practice – while Part III looks at what factors underpin success, discussing the social and psychological aspects involved in successful innovation engineering. Consideration is also given to recent developments and systems which will assist in ensuring the continuation of this process in the future.

Book excerpt: As a result of the incorporation of computer software into countless commercial and industrial products, the patentability of software has become a vital issue in intellectual property law. This indispensable book provides an overview on the current status of computer-implemented inventions in patent law across Europe and major jurisdictions worldwide. A hugely practical field research tool with guidance based on case law, it examines the major hurdles in each particular country and describes the best practice to be adopted. Clearly showing how enforceable software patent applications can be competitively drafted and how a patent portfolio for computer-implemented inventions can be established in several countries without spending money unnecessarily on problematic examination proceedings, this book covers such issues and topics as the following: • claim categories for patent applications; • sufficient level of abstraction/breadth of the claimed invention; • fundamental terms of computing and terminological traps; • probability for patents dependent on software application areas; and • patents in core areas of computing. With separate chapters for the key countries, Germany, the United Kingdom, France, the United States, China, Korea, Japan, India, and the European Patent Office the legal situation for computer-implemented inventions in each country or region, this book includes guidance on prosecution under national law, analyses of relevant court decisions, practice checklists, and an outlook on future developments.. The authors describe claim formulation based on actual cases and on principles of computer science in order to show what might be or might not be patentable in each jurisdiction. With this incomparable resource, patent attorneys and patent professionals in companies will get a basis for making decisions about the most appropriate jurisdictions in which to file patent applications. This book will also be of great value to computer professionals who are affected by the protection of software or who are actively involved in the protection of software by patent law.

Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this monograph provides a survey and analysis of the rules concerning intellectual property rights in France. It covers every type of intellectual property right in depth – copyright and neighbouring rights, patents, utility models, trademarks, trade names, industrial designs, plant variety protection, chip protection, trade secrets, and confidential information. Particular attention is paid throughout to recent developments and trends. The analysis approaches each right in terms of its sources in law and in legislation, and proceeds to such legal issues as subject matter of protection, conditions of protection, ownership, transfer of rights, licences, scope of exclusive rights, limitations, exemptions, duration of protection, infringement, available remedies, and overlapping with other intellectual property rights. The book provides a clear overview of intellectual property legislation and policy, and at the same time offers practical guidance on which sound preliminary decisions may be based. Lawyers representing parties with interests in France will welcome this very useful guide, and academics and researchers will appreciate its value in the study of comparative intellectual property law.

Book excerpt: The recent “concept of 2.0", a consequence of "Web 2.0", discusses the emergence of a new style, emancipated from the Web, which finds applications in all areas of social activity: management, innovation, education , organization, territory, etc. This book considers the implications of the changing paradigm for competitive, economic and territorial intelligence applied to innovation, value creation and enhancement of territories. Competitive intelligence is therefore in the "2.0" and its values: perpetual beta, user-generated content, social relations, etc., horizontality, a renewed legitimacy. This book, collecting contributions from international experts, testifies to the heterogeneity and richness of possible approaches. It provides a totally new way of evaluating the impact of 2.0 with concrete examples, while analyzing the theoretical models allowing the reader to develop in other contexts the described cases of success.
