Book excerpt: En el entramado internacional de protección de los derechos humanos, la aprobación en 2008 por Naciones Unidas del Protocolo Facultativo del Pacto Internacional de Derechos Económicos, Sociales y Culturales ha supuesto un hito en el largo camino que se recorre hacia la equiparación de las distintas categorías de derechos humanos. Y es que finalmente, mediante dicho Protocolo, se reconoce formalmente a los derechos económicos, sociales y culturales un estatus de protección parejo al de que venían gozando desde hace tiempo los derechos civiles y políticos. Contribuye a la aludida equiparación la previsión de un mecanismo de comunicaciones individuales mediante el cual se habilita la posibilidad de que la ciudadanía denuncie ante el Comité de Derechos Económicos, Sociales y Culturales la violación de alguno de los derechos contenidos en el Pacto, para que se ponga fin y remedie dicha situación de conculcación. Se articula, pues, un sistema cuasi judicial de protección y tutela de los derechos económicos, sociales y culturales. El objeto de la obra que el lector tiene en sus manos es el análisis del mencionado Protocolo, reparando en especial en dicho sistema de comunicaciones individuales, así como en el resto de mecanismos de tutela previstos en el mismo. Para ello, se parte del estudio de los sistemas de tutela previstos originariamente en el Pacto Internacional de Derechos Económicos, Sociales y Culturales, incorporando así la perspectiva diacrónica. Asimismo, a lo largo del trabajo se hace constante referencia a otros instrumentos internacionales de protección de derechos humanos y de derechos económicos, sociales y culturales, de modo que se aporta un apunte comparativo, para la mejor comprensión del alcance del Protocolo.

Para ello, la autora, que formó parte del equipo de trabajo de la investigación que desembocó en “El Oasis de la Memoria”, analiza en detalle 95 casos de desaparición forzada, 86 de ellos recogidos en dicha publicación y los nueve restantes, en “Meheris: la esperanza posible”. La investigadora indica que es necesaria “una voluntad política real por transformar la realidad y romper con el pasado de violaciones de derechos humanos” y denuncia que “no se haya respetado el derecho de las víctimas a la verdad”. Los resultados del trabajo, según apunta López, se espera que sirvan para que las personas afectadas puedan defender sus derechos ante las instancias internacionales y la Audiencia Nacional española.

Since the democratic transitions of the 1980s, most countries have amended their constitutions at least once, and some have even undergone constitutional reform several times. The global phenomenon of a new constitutionalism, with enhanced rights provisions, finds expression in the region, but the new constitutions, such as those of Bolivia, Colombia, Ecuador and Venezuela, also have some peculiar characteristics which are discussed in this important book. Authors from a number of different disciplines offer a general overview of constitutional reforms in Latin America since 1990. They explore the historical, philosophical and doctrinal differences between traditional and new constitutionalism in Latin America and examine sources of inspiration.
