Di tale opportuna modernizzazione, da cui sono derivate sostanziose modifiche, anche strutturali, si è reso necessario valutare attentamente la portata pure con riferimento alla compatibilità con le ordinarie regole processuali. E d’altra parte – considerata l’evoluzione degli strumenti sovranazionali non solo di matrice europea – l’esigenza di un aggiornamento della normativa nazionale risultava non più rinviabile e proprio per questo che il legislatore ha colto l’occasione per tentare la razionalizzazione e lo snellimento della disciplina esistente in tale settore così da renderla maggiormente efficiente. Appare chiaro come si sia resa necessaria un’analisi volta a verificare la reale portata dell’attuale normativa anche al fine di valutare se la “nuova” cooperazione giudiziaria disegnata dal nostro legislatore e da quello sovranazionale possa effettivamente raggiungere lo scopo al quale è stata preordinata.
