Available in PDF, EPUB and Kindle. Book excerpt: ′In this pathbreaking volume Muncie and Goldson bring together leading authors to examine and compare youth justice systems around the world. Comparative Youth Justice will be of interest to all criminologists concerned with comparative penal policy and will be essential to all scholars of youth justice′ - Professor Tim Newburn, London School of Economics and Political Science and President of the British Society of Criminology ′Comparative Youth Justice is what we need in an era of hardening social policies and irresponsible political demagoguery: thoughtful critiques, comparative analysis, and a commitment to the rights of youth. John Muncie and Barry Goldson have done a fine job of bringing together a group of commentators who know the inner workings of juvenile justice and what it will take to change the current law and order model. A book that is required reading for practitioners, professors, policy makers, researchers, and students concerned about the bankrupt state of juvenile justice and willing to consider new ideas and directions′ - Tony Platt, California State University, Sacramento With contributions from leading commentators from 13 different countries, this carefully integrated edited collection comprises the most authoritive comparative analysis of international youth justice currently available. However, Comparative Youth Justice is not simply an attempt to document national similarities and differences, but looks critically at how global trends are translated at the local level. This book also examines how youth justice is implemented in practice with a view to promoting change as well as reflection. Each chapter addresses key critical issues: - the degree of compliance with international law; - the extent of repenalistion; - adulteration; - tolerance; - the impact of experiments in restoration and risk management. This book is designed as a companion volume to Youth Crime and Justice, edited by Barry Goldson and John Muncie, published simultaneously by SAGE Publications. ′This is a brilliant set of edited volumes that will be an indispensable and timely source of information and analysis for anyone with an interest in issues of youth justice and comparative criminology.′ David A. Green, Oxford University

Book excerpt: Transformations to the criminal justice system in Western societies are often linked with broader social and cultural changes, and this work presents the recent changes in juvenile justice in Canada and nine European countries and the sociopolitical context in which they take place. The study provides a comparison of the sentencing practices of each country, focusing on three dimensions related to the sanction practices: the custodial sanctions, the alternative sanctions, and the extension of the judicial thinking into relative fields such as school, training, and social policies. With clear and thoroughly developed research methods, this analysis illustrates that changes in juvenile justice policies are not specifically the result of differences in crime rates or the evolution of deviant youth behavior, but rather the effect of complex interactions with a variety of social, economical, cultural, and political factors.

Available in PDF, EPUB and Kindle. Book excerpt: How do political regimes respond to the challenges emanating from youth mobilization? This book seeks to understand regime resilience and breakdown by analysing the public meaning of youth, as well as the physical mobilization of young people. Mobilization carried by young people is a key component in understanding the stabilisation of the authoritarian regime structures in contemporary Russia, but the Russian experience makes only sense if placed in its broader historical context.Three comparative cases, the breakdown of the authoritarian Soviet Union, the breakdown of the democratic Weimar Republic, and the crisis of the democratic regime in France around 1968 highlight how regimes which lacked popular support have compensated for their insufficient legitimacy by trying to mobilize youth symbolically and politically. This book illustrates the symbolic significance of youth and its role in regime crisis by analysing a new data set of newspaper articles with a new method of discourse analysis. The combination of qualitative interpretation and quantitative network analysis enables a deeper and more systematic understanding of discursive structures about youth. Through this methodological innovation the book contributes to the way we define the categories of youth, generation, and crisis. It makes the case that our conceptualisation should reflect the way terms are being used - usages that can be captured in a systematic way with new methods of discourse analysis. Oxford Studies in Democratization is a series for scholars and students of comparative politics and related disciplines. Volumes concentrate on the comparative study of the democratization process that accompanied the decline and termination of the cold war. The geographical focus of the series is primarily Latin America, the Caribbean, Southern and Eastern Europe, and relevant experiences in Africa and Asia. The series editor is Laurence Whitehead, Senior Research Fellow, Nuffield College, University of Oxford.

Available in PDF, EPUB and Kindle. Book excerpt: Basing much of its analysis upon the first systematic empirical study of the French pre-trial process, this monograph breaks new ground in the field of comparative criminal justice. Moving away from idealised accounts of judicially supervised investigations, it provides a better understanding of the ways in which an inquisitorially rooted criminal process operates in practice and the factors that influence and constrain its development and functioning. The structure and operation of French criminal justice is set within a broad range of contexts of political, occupational and legal cultures from the French Republican tradition of state-centred models of authority, across the growing influence of the ECHR, to the local conditions which determine the ways in which individual discretion is exercised. The French model of investigative supervision and accountability is contrasted with more adversarial procedures and in particular, the different ways in which the reliability of evidence is guaranteed and the interests of the accused protected. Systematic observation of the daily working practices of police, gendarmes, prosecutors and juges dinstruction across a number of sites and time periods, provides a unique and detailed account of the ways in which the French criminal process operates in practice. The understandings and insights generated from this data are then set within a wider legal and political analysis, which considers issues such as the influence and interference of the State within matters of justice; a comparative analysis of the judicial and defence functions; and the extent to which ECHR fair trial guarantees are able to produce legal and ideological change within a process which depends upon a central and judicially supervised investigating authority. An informed knowledge of other European criminal procedures is increasingly essential for those working within UK (as well as comparative) criminal justice, if there is to be a proper engagement with, and evaluation of, measures such as the EUs proposed Council Framework Decision on Certain Procedural Rights in Criminal Proceedings throughout the European Union, as well as recent legislative reform in England and Wales that seeks to adjust the pre-trial roles of police and prosecutor in significant ways. This book will be essential reading for teachers, researchers, students and policy-makers working in the areas of criminal justice in the UK and across Europe, in comparative criminal justice/criminology, as well as in French and European studies.

Book excerpt: This innovative text examines contemporary issues in youth justice in the light of the sweeping reforms introduced by the Crime and Disorder Act 1998 and the Youth Justice and Criminal Evidence Bill 1999. It brings together current debates in both the practice and theory of youth justice intervention and, in the light of the governments inter-agency approach to the problem of youth criminality, provides an inter-disciplinary examination of these discussions. Including contributions from both academics, magistrates and social work practitioners, it is a useful text for students of criminology, law and social work, as well as a valuable resource for youth justice practitioners.

This book was released on 2018-02-12 with total page 292 pages. Available in PDF, EPUB and Kindle.

Book excerpt: This book brings together a collection of leading international experts to explore the lessons learnt through implementation and the future directions of crime prevention policies. Through a comparative analysis of developments in crime prevention policies across a number of European countries, contributors address questions such as: How has 'the preventive turn' in crime control policies been implemented in various different countries and what have its implications been? What lessons have been learnt over the ensuing years and what are the major trends influencing the direction of development? What does the future hold for crime prevention and community safety? Contributors explore and assess the different models adopted and the shifting emphasis accorded to differing strategies over time. The book also seeks to compare and contrast different approaches as well as the nature and extent of policy transfer between jurisdictions and the internationalisation of key ideas, strategies and theories of crime prevention and community safety.

Available in PDF, EPUB and Kindle. Book excerpt: Victim-offender mediation schemes have experienced significant growth in the last decade. They are seen as an important and innovative alternative to the traditional sanctions of the criminal justice system. After a critical look at mediation schemes in the United States and Canada, most European countries have also increased their efforts to develop informal strategies to deal with deviant behavior. In terms of their legal and organizational base, it turns out that type, extent, and capacities for development are quite different in the individual countries -resulting in a remarkable diversity of programs with different outcomes. The contributions in this book are revised and edited versions of papers presented at the NATO Advanced Research Workshop Conflict, Crime and Reconciliation: The Organization of Welfare Intervention in the Field of Restitutive Justice in April 1991 at Il Ciocco, Italy. The chapters document the present stage of restorative justice in the individual countries, critically assess legal constraints and public needs, discuss the organizational requirements of implementation, and also evaluate outcomes in a broader context of crime and social policy. In the long run, this book should encourage further debates in the field of restorative justice and help build valid guidelines for an international evaluation research.

Book excerpt: Rebuilding community connections outlines the main features of restorative justice, including different models and research findings, and proposes guidelines for setting up programmes. It also identifies problems and ways of dealing with them. This guide provides essential information for those planning to introduce restorative justice, in particular countries in central and eastern Europe. For countries that have already done so, it offers an opportunity to review practice in the light of experience and research elsewhere. -- Council of Europe.
