Book excerpt: La capacité est l'une des conditions de formation du contrat. Malgré l'existence d'un principe de capacité contractuelle, la définition de la capacité dans les contrats a été délaissée. Et c'est sur la délimitation de la notion d'incapacité que le droit civil s'est focalisé. L'étude du droit positif montre que l'incapacité de contracter peut avoir pour objet de protéger l'incapable ou de se protéger de l'incapable. Dans les deux hypothèses, c'est la protection du contractant vulnérable qui est recherchée. En général, la méthode utilisée pour protéger le contractant, partie faible au contrat, consiste à l'empêcher de contracter personnellement. Malgré cette finalité protectrice, la réduction de l'exercice de droits est contestée. Certaines mesures d'assouplissement dans le droit des incapacités contractuelles se sont notamment développées. L'objet de cette étude est double. Il est d'une part de montrer comment il est possible de protéger le contractant vulnérable en soutenant sa capacité contractuelle plutôt que de l'exclure de la vie contractuelle par une mesure d'incapacité. Il est d'autre part de montrer que la notion de capacité contractuelle permet d'appréhender plus largement la vulnérabilité contractuelle. Cette démarche dynamique de la protection des parties faibles au contrat permet de placer la notion de capacité au cœur d'un mouvement de correction des inégalités entre contractants. Moins vulnérable, le contractant peut être plus libre dans ses choix, et donc plus responsable.
