This book was released on 2019 with total page 496 pages. Available in PDF, EPUB and Kindle.
Book Synopsis Improperly Obtained Evidence in Anglo-American and Continental Law by : Dimitrios Giannoulopoulos

This book was released on 2019-02-21 with total page 349 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first book to offer an extensive cosmopolitan, cross-cultural insight into the perennial controversy over the use of improperly obtained evidence in criminal trials. It challenges the conventional view that exclusionary rules are idiosyncratic of Anglo-American law, and highlights the 'constitutionalisation' and 'internationalisation' of criminal evidence and procedure as a cause of rapprochement (or divergence) beyond the Anglo-American and Continental law divide. Analysis focuses on confessional evidence and evidence obtained by search and seizure, telephone interceptions and other means of electronic surveillance. The laws of England and Wales, France, Greece and the United States are systematically compared and contrasted throughout this study, but, where appropriate, analysis extends to other Anglo-American and Continental legal systems. The book reviews exclusionary rules vis-à-vis the operation of judicial discretion, and explores the normative justifications that underpin them. It attempts to reinvigorate the idea of excluding evidence to protect constitutional or human rights (the rights thesis), arguing that there is significant scope for Anglo-American and Continental legal systems to place a renewed emphasis on it, particularly in relation to confessional evidence obtained in violation of custodial interrogation rights; we can locate an emerging rapprochement, and unique potential for European Court of Human Rights jurisprudence to build consensus in this respect. In marked contrast, remaining divergence with regard to evidence obtained by privacy violations means there is little momentum to adopt a reinvigorated rights thesis more widely. Longlisted for the Inner Temple Book Prize 2022.

Download or read book A War on Terror? written by Marianne Wade and published by Springer Science & Business Media. This book was released on 2009-11-05 with total page 554 pages. Available in PDF, EPUB and Kindle. Book excerpt: Marianne Wade and Almir Maljevi? Although the worries about terrorism paled in comparison to the economic crisis as a topic during the last US election, one can find plenty of grounds to assume that they remain issue number one in the minds of politicians in Europe. As the German houses of Parliament prepare to call in the mediation committee in the discussion of legislation which would provide the Federal Police – thus far mandated purely with the post-facto investigation of crime – with powers to act to prevent acts of terrorism, Spain’s struggle with ETA and the British Government licks its wounds after a resounding defeat of its latest anti-terrorist proposals by the House of Lords, one cannot but wonder whether post 9/11, the Europeans are not even more concerned with terrorism than their US counterparts. A look at media reports, legislative and judicial activities in either Britain or Germany clearly underlines that those two countries are deeply embroiled in anti-terrorist activity. Can it be that Europe is embroiled in the “War on Terror”; constantly providing for new arms in this conflict? Or is it a refusal to participate in the “War on Terror” that fuels a constant need for Parliaments to grapple with the subject; begrudgingly conceding one increasingly draconian measure after the other? The question as to where Europe stands in the “War on Terror” is a fascinating one, but one, which is difficult to answer.

Available in PDF, EPUB and Kindle. Book excerpt: Joly's (1831-78) Dialogue aux enfers entre Machiavel et Montesquieu is the major source of one of the world's most infamous and damaging forgeries, The Protocols of the Elders of Zion. That, however, was concocted some two decades after he died, and American political scientist Waggoner points to Joly's own text for evidence that he was not anti-semitic and was an intransigent enemy of the kind of tyranny the forgery served during the 1930s. He translates the text and discusses Joly's intentions in writing it and his contribution to the understanding of modern politics. Annotation copyrighted by Book News, Inc., Portland, OR.

This book advances cutting-edge theories and methods, with the aim of moving beyond the scholarship that reproduces insecurity and exclusion. The breadth of approaches encompasses much of the current critical criminological scholarship, serving as a counterpoint to the growth of managerial and administrative criminologies and the rise of explicitly exclusionary and punitive state policies and practices with respect to ‘crime’ and ‘security.’ This edited collection featuring two books, one in English and one in French, includes important contributions to knowledge and public policy by eminent experts and emerging scholars. Book excerpt: Jody Blake demonstrates in this book that although the impact of African-American music and dance in France was constant from 1900 to 1930, it was not unchanging. This was due in part to the stylistic development and diversity of African-American music and dance, from the prewar cakewalk and ragtime to the postwar Charleston and jazz. Successive groups of modernists, beginning with the Matisse and Picasso circle in the 1900s and concluding with the Surrealists and Purists in the 1920s, constructed different versions of la musique and la danse negre. Manifested in creative and critical works, these responses to African-American music and dance reflected the modernists' varying artistic agendas and historical climates.

Book Synopsis Zacarias, My Brother by : Abd Samad Moussaoui
Download or read book Zacarias, My Brother written by Abd Samad Moussaoui and published by Seven Stories Press. This book was released on 2011-01-04 with total page 148 pages. Available in PDF, EPUB and Kindle. Book excerpt: Zacarias Moussaoui was arrested in the United States in August 2001. He is currently in a federal prison in Virginia, charged with "conspiring with Osama bin Laden and Al-Qaeda to murder thousands of innocent people in New York, Virginia, and Pennsylvania." Moussaoui , who trained to be a pilot in Oklahoma, admits to being a member of Al-Qaeda but denies involvement in the events of September 11. He has opted to defend himself. Written by his brother, Zacarias, My Brother tells the story of Zac’s life from birth to the time in 1996 when he broke contact with his family and became deeply involved with Muslim fundamentalists in London. It is a unique document about what it is to grow up a Muslim in Western Europe today and how an extremist is made. In Zacarias, My Brother, author Abd Samad Moussaoui describes the struggle that young Arab men and their families endure in Europe, seeking an education and equal opportunity, only to find most avenues of assimilation effectively barred to people of color. At the same time, he authoritatively details the techniques of the extremist sects that recruit potential terrorist cadres. Members of the Wahhabi sect have perfected a rhetoric that appeals to the wounded pride of these young Arab men, Moussaoui writes—for example, offering funds to help them complete their education. Moussaoui deplores the route taken by his brother. He is not in any way an apologist for terrorism. Even so, he shows convincingly that normal young men can end up terrorists, and suggests how and why this happens. Moussaoui shows with gripping clarity how Wahhabism distorts true Islamic faith and the threat it poses to Islam. And his book strongly suggests that the best defense against terrorist groups like the Wahhabi sect in the future is anything people can do to end racism.

Book Synopsis Toward a New Poetics by : Serge Gavronsky
Download or read book Toward a New Poetics written by Serge Gavronsky and published by Univ of California Press. This book was released on 1994-12-01 with total page 388 pages. Available in PDF, EPUB and Kindle. Book excerpt: A quiet revolution is taking place in avant-garde French poetry and prose. In this collection of twelve interviews with some of France's most important poets and writers, Serge Gavronsky introduces American readers to these exciting new developments. As Gavronsky explains, a neolyricism is now replacing the formalism of the 1960s, '70s, and '80s. In his substantial introduction, Gavronsky notes how the ideological definition of writing (écriture) has given way to more open forms of writing. Human experiences of the most ordinary kinds are finding a place in the text. These interviews offer a view of the poets' and writers' creative processes and range over such topics as current literary theory, the impact of American poetry in France, and the place of feminism in contemporary French writing. Each interview is accompanied by samples of the writer's work in French and in Gavronsky's English translations. Toward a New Poetics provides a highly informative cultural and critical perspective on contemporary writing in France, introducing us to works which are now transforming the idea of literature itself.
