Gli Stati sono chiamati a garantire la coesione sociale a partire da tale Diritto. Uno dei luoghi dove più frequentemente sorgono conflitti religiosi è l’ambiente di lavoro. I conflitti sono causati soprattutto dagli aspetti relativi alla manifestazione del credo religioso attraverso l’abbigliamento e dalla possibile incompatibilità degli orari e delle mansioni con taluni dei precetti derivanti dalle regole della religione professata. L’autrice affronta diffusamente le situazioni di conflitto che si presentano negli ambienti di lavoro, le normative statali e sovranazionali e la giurisprudenza delle Corti internazionali tenendo presente la distinzione tra il lavoro pubblico e quello privato che, non di rado, sono oggetto di differenti approcci. Nell’analizzare, sotto il profilo concettuale, le teorie sulla libertà religiosa, evidenzia le incongruenze che si riscontrano nelle teorie della neutralità e della laicità. Ampia parte della trattazione è dedicata alle modalità di soluzione del conflitto religioso all’interno degli ambienti di lavoro, sulla base dell’elaborazione giurisprudenziale, a partire dall’analisi della natura della discriminazione – diretta o indiretta – e dell’utilizzo del test di proporzionalità, che l’autrice mette a confronto con l’accomodamento ragionevole. Dalla comparazione emergono differenti peculiarità che fanno propendere l’autrice per un più diffuso utilizzo delle tecniche dell’accomodamento ragionevole. Una parte della trattazione è dedicata al diritto all’obiezione di coscienza per motivi religiosi del personale sanitario, con particolare riferimento alla legge italiana sul fine vita. Un capitolo è dedicato allo studio della tutela della libertà religiosa delle organizzazioni religiose al fine di verificare se il principio di neutralità possa essere assunto quale giustificazione della tendenza da parte delle imprese private che operano nel mercato al pari delle altre imprese.
