En este sentido, desde el año 2011, esa realidad comienza a cambiar y a tener una hoja de ruta efectiva porque aterriza la responsabilidad del Estado a terceros, inclusive, a la empresa.En el año 2011 el Consejo de Derechos Humanos de Naciones Unidas, hace suyo los Principios Rectores (PR) sobre la Empresas y los Derechos Humanos, obra realizada por encargo del ciudadano Secretario General y elaborado por el representante especial de éste para la cuestión de los Derechos Humanos y las Empresas transnacionales y otras empresas, cuyo eje motriz lo constituyen tres grandes columnas, proteger, respetar y remediar; y en la actualidad, más países lo asumen con responsabilidad y convicción.La esencia espiritual de estos Principios está en su propia naturaleza y en la naturaleza del Desarrollo Sustentable. No suponen nuevas obligaciones para nadie; sin embargo, la experiencia aconseja que se deba implementar un Plan Nacional de Acción como primera estación, que permita su puesta en marcha de manera coordinada y sistemática, en virtud de tratarse de un cambio de paradigma empresarial.La urgencia de seguir creciendo económicamente para abastecer las necesidades de los seres humanos, pasa fundamentalmente por respetar los derechos de las personas; el derecho de las próximas generaciones a disfrutar de un planeta sano, el derecho a un ambiente limpio y equilibrado, el derecho a la buena salud y el derecho al trabajo decente, que son entre otros, los derechos que las empresas deben respetar y el Estado proteger, y ante la existencia de lesiones a esos derechos, dar las condiciones para remediar.En apariencia, los países latinoamericanos tienen un gran rezago en esta materia; sin embargo, el Gobierno peruano ha adoptado un Plan Nacional de Acción desde el año 2018 el cual debe concluir en el año 2021. Los Principios Rectores sobre las Empresas y los Derechos Humanos constituyen un modelo único, coherente, inclusivo y complementario que relaciona los deberes y obligaciones de unos, con los derechos de otros.
