Book excerpt: Con "Giurisdizione civile e straniero tra diritto nazionale, europeo ed internazionale" si propone una panoramica, anche se parziale, dell'attuale tensione che sta vivendo il nostro ordinamento giuridico, per il sempre più massiccio "ingresso" del diritto comunitario anche nella sua componente giurisdizionale. Si parte dalle requisitorie, che nell'interesse della legge, sono redatte dal Procuratore generale, in completa solitudine scientifica, professionale ed umana, servendosi della sua onestà professionale ed intellettuale, per il regolamento di giurisdizione, che presentino carattere, per così dire, di internazionalità, ma le cui argomentazioni restano ignote, limitandosi, per la maggior parte dei casi, come è noto, la decisione del collegio giudicante ad evidenziarne le conclusioni. Anche se le questioni sono trattate sotto il profilo della giurisdizione, si pone il rilievo che, ex actis, si è in presenza di una evoluzione giuridica, sia pure lenta, verso un diritto privato europeo, che anche nella sua terminologia essa si propone, talvolta, come dissonante per la dottrina e la giurisprudenza italiane. A tal fine, oltre il testo integrale della requisitoria, per ogni questione vi sono riscontri aggiornati di giurisprudenza interna ed europea, di suggerimenti dottrinari per cui il giurista – teorico e/o pratico – può valutare lo status quaestionis in ogni suo risvolto. In questa direzione "Giurisdizione civile e straniero tra diritto nazionale, europeo ed internazionale" intende evidenziare la faticosa marcia verso l'obiettivo di una codificazione uniforme nei vari Stati membri dell'Unione, avviata in modo deciso e sembra irreversibile non tanto dal legislatore comunitario, quanto dalla Corte di Giustizia, con una paziente normopoiesi, per cui, ritiene l'Autore che la giurisprudenza "europea" ormai costituisce una autentica fonte del diritto anche italiano, ormai deprovincializzantesi se non già de provincializzato.

La Méthode de la Référence à l'Ordre juridique compétent en Droit international privé, Paolo Picone Paolo Picone, Professor at the University of Naples, notes in the introduction to his course that contemporary international law, such as it evolved during the 19th century, developed different methods of coordination. One method has nevertheless been neglected, which consist in choosing not the applicable law, but the competent legal system. After discussing the crisis in private international law, the author examines the method of coordination of legal systems based on the applicable law, followed by one that is based on reference to the @@@competent legal system. @@@He describes the functioning of the latter method in the case of the creation of legal situations in the @@@for, and in the case of recognition of foreign legal situations in the for. Book excerpt: The reports collected in this book were prepared at the initiative and under the auspices of the Project on International Procedure of the School of Law of Columbia University within the framework of its co-operation with the Commission on International Rules of Judicial Procedure, a body created by Act of Congress of September 2, 1958, 72 Stat. 1743. The Commission is charged with studying domestic and foreign procedures of international co-operation in litigation with a view to suggesting improvements. Since June 1960, the Project has assisted the Commission in carrying out this statutorily assigned task. Work on the reports here presented was begun in the fall of 1960. The Project invoked the assistance of an active practitioner in each of the foreign countries se1ected and submitted to hirn an extensive questionnaire summarizing American procedures and posing detailed quest ions about foreign practices. The elaborate answers to these questionnaires provided the information on which the American co authors relied in drafting the English versions of the reports. By having proceeded in this fashion, the Project hopes to have prepared reports that reflect the knowledge and experience of the foreign practitioners and at the same time are drafted in terms intelligible to common law lawyers. Furthermore, to ensure that the reports would take due account of official views, in almost all instances, final drafts of the reports were submitted for comments and suggestions to appropriate foreign public officials.
