Book excerpt: Gossage uses a family-reconstitution method, drawing on local parish registers and manuscript-census schedules, to focus on marriage, household organization, and family size in this context of social and economic change. Family formation was profoundly affected as couples adjusted to the new urban, industrial setting. Gossage demonstrates that demographic behaviour was increasingly differentiated by social class, with distinct marriage and fertility patterns emerging among bourgeois and proletarian families. Bourgeois women who married in the 1860s, for example, were already limiting family size, a crucial shift that did not occur in working-class families until almost a generation later. Families in Transition demonstrates the extent to which stereotypes about family life in Quebec before the Quiet Revolution need to be revisited. Far from being passive, static, uniformly prolific, and constrained by religious and cultural perspectives, Saint-Hyacinthe families responded quickly to the changing realities of the day, reinventing marriage patterns and domestic arrangements to fit the new industrial capitalism of the nineteenth century. In this sense they were truly families in transition.

As the industrial era took hold, a new model was forged, built on the values of secularism and individualism. Jeffery Vacante’s perceptive analysis reveals how French Canadian intellectuals defined masculinity in response to imperialist English Canadian ideals. This “national manhood” would be disentangled from the workplace, the family, and the land and tied instead to one’s cultural identity. The new formulation was crucial in the larger struggle to modernize Quebec’s institutions while preserving French Canadian community, faith, and culture. It contributes to the topical academic debate on ‘family law exceptionalism’ by exploring the blurred lines between public law, private law and family law, and sheds light on the many shades of grey that exist. The contributions focus on both substantive and procedural family law on parents and children and on life partners, with particular attention for contractual arrangements of family formations and of conflict resolution. The hypothesis underlying all contributions was the trend towards contractualisation of family law. A convergent research outcome resulting from the comparison of national reports was the ambivalent position of family law in legal systems worldwide. That comparison shows that, whereas family law is clearly moving towards contract with regard to old family formations, the contrary is true for new family formations. The movement towards contract is rarely considered to be contractualisation pur sang, with civil effect. The movement towards status, finally, does not necessarily witness ‘family law exceptionalism’ vis-à-vis private law, in view of the increasing State interventionism in private law relations in general. In sum, as the volume shows, the high permeability of the demarcations between the State, the family and the market impedes a categorial approach. This volume is based on the general and selected national reports on the topic “Contractualisation of Family Law” that were presented at the XIXth International Congress of Comparative Law in Vienna in July 2014.
