Entre estas últimas se encuentra el tratamiento que se ha de dar a la delincuencia de origen extranjero, que en el Ordenamiento jurídico español cuenta con una trayectoria legislativa vacilante que no es ajena a las tensiones dialécticas entre los partidarios de un mayor control de los flujos migratorios y los partidarios de unas políticas menos restrictivas de la inmigración. Sin duda, la expulsión del territorio nacional, constituye la peculiaridad más relevante derivada de la condena de un ciudadano extranjero por la comisión de un delito. En nuestro Ordenamiento tiene su reflejo, tanto en la legislación de extranjería como en la penal, lo que acarrea no pocas dificultades a la hora de deslindar su ámbito y delimitar su auténtica naturaleza jurídica. Esta obra se centra en examinar esta regulación de la expulsión en el espacio del proceso penal. Se analiza la incidencia del art. 57.7 de la Ley de Extranjería en la renuncia al ejercicio del ius puniendi, en el caso de extranjero investigado cuya expulsión ha sido acordada administrativamente. Pero, sobre todo, este trabajo aborda el estudio de los arts. 89 y 108 Código Penal, que regulan la figura de la expulsión judicial, que ha sufrido una radical reforma tras la entrada en vigor de la LO 1/2015, de 30 de marzo, ampliando su ámbito subjetivo de aplicación a cualquier extranjero, incluidos ciudadanos de la Unión Europea. A través de una abundante referencia bibliográfica y jurisprudencial, se repasa en profundidad la práctica aplicativa de los diversos tipos de expulsión contenidos en los arts. 89 y 108 CP, tanto desde su punto de vista material como procesal, tratando las cuestiones más actuales que suscita la nueva regulación introducida por la LO 1/2015, de 30 de marzo. Se incorpora además un capítulo dedicado a los “re- medios” alternativos a la expulsión judicial, representados por el traslado para cumplimiento de la condena penal en el país de origen del penado extranjero o, en su caso, disfrute de la libertad condicional. Tampoco olvida la obra hacerse eco del amplio debate doctrinal que suscita la figura de la expulsión judicial, reflexionando sobre las diversas posibilidades que ofrece su configuración legal, haciendo referencia a diversas soluciones que en Derecho comparado se han adoptado. El autor, Doctor en Derecho por la Universidad de Vigo, ha desempeñado su labor profesional desde las más importantes posiciones del operador jurídico, tanto como Letrado, como Juez, Fiscal y Letrado de la Administración de Justicia, lo que le permite un profundo conocimiento del sistema judicial español, que, a su vez, se traduce en un equilibrado manejo de conocimientos prácticos y teóricos de la Ciencia del Derecho.
