Book excerpt: Tra le misure alternative, la detenzione domiciliare è, ed è sempre stata, la misura privilegiata dal legislatore per far fronte al problema del sovraffollamento carcerario, che, oltre a condurre inevitabilmente alla violazione dei diritti fondamentali dei detenuti, costituisce un ostacolo insormontabile alla realizzazione della finalità rieducativa assegnata alla pena dalla Costituzione. Le ragioni di tale predilezione sono fondamentalmente due: la detenzione domiciliare non ha costi per lo Stato, in quanto il mantenimento, la cura e l’assistenza medica del detenuto domiciliare non gravano sull’amministrazione penitenziaria, ma sul detenuto medesimo, in qualità di comune cittadino; la misura in oggetto è inoltre la più contenitiva e, perciò, la più rispondente alle esigenze di sicurezza e prevenzione. Ma la detenzione domiciliare non può certo dirsi la misura alternativa per eccellenza, tant’è che in dottrina ancora oggi si discute sulla sua natura giuridica e sulla sua efficacia rieducativa. La detenzione domiciliare è stata perciò oggetto di numerosi interventi volti ad espanderne il campo di applicazione, interventi che hanno aumentato i limiti edittali, hanno incluso ulteriori beneficiari e previsto nuove condizioni legittimanti l’accesso sicché ad oggi le ipotesi di detenzione domiciliare sono molteplici, soddisfano finalità fra loro molto diverse e addirittura convivono ipotesi tra loro sovrapponibili, ma concedibili sulla base di presupposti e procedimenti diversi, come nel caso dell’esecuzione della pena presso il domicilio, introdotta con carattere provvisorio, ma in seguito entrata a regime, che condivide sostanzialmente il suo campo d’azione con la detenzione domiciliare generica biennale.L’opera ripercorre l’evoluzione normativa che ha condotto all’attuale disciplina della detenzione domiciliare, illustra le modalità esecutive della misura, descrive le specifiche ipotesi di detenzione domiciliare, il procedimento per l’accesso e la revoca e si sofferma infine su due ipotesi di detenzione domiciliare non disciplinate dall’ordinamento penitenziario: la detenzione domiciliare per i collaboratori di giustizia introdotta con decreto legge del 15 gennaio 1991 n. 8 e l’esecuzione della pena presso il domicilio prevista dalla legge n. 199 del 2010.
