Cet intérêt s'est matérialisé au milieu du vingtième siècle par les conquêtes de l'espace interstellaire et de la lune, grâce au développement des moyens techniques qui ont permis à l'homme d'évoluer dans ce milieu. Les nations ont alors ressenti le besoin d'élaborer sous l'égide de l'Organisation des Nations-Unies un corps de règles juridiques pour encadrer conventionnellement les activités spatiales naissantes pour qu'elles ne deviennent pas anarchiques. Ces règles se sont cristallisées dans un statut juridique qui est devenu celui de l'espace extra-atmosphérique, qui comporte en son sein une philosophie hautement humaniste et qui s'appuie sur deux principes fondamentaux parfaitement symétriques qui tiennent à la non appropriation du milieu spatial pour qu'il soit librement utilisable par l'ensemble et pour l'ensemble des Etats de notre planète. Il reste à préciser que la mondialisation de l'économie de marché et le développement des conflits terrestres auxquels on assiste de nos jours, ont accéléré la mutation des activités spatiales qui intègrent de plus en plus des données économiques et stratégiques qui concurrencent directement l'essence humaniste dudit statut juridique sans pour autant l'avoir fait disparaître.
